25.01.2022 Press release for TfNSW NSW to welcome a fairer playing field for taxis and hire vehicles Published 18 Aug 2017... New rules for the taxi, rideshare and hire car industry. A focus on customer safety and fare flexibility is at the heart of new rules for the taxi, rideshare and hire car industry to come into effect on 1 November 2017. Delivering on a commitment to provide more choice and flexibility for customers and a more level playing field for service providers, the final Point to Point Transport (Taxis and Hire Vehicles) Regulation 2017 has been published following public consultation on a draft of the new rules during April and May, a Transport for NSW Spokesperson said. One major change customers will notice is the requirement for service providers to provide an up-front fare estimate when they book a trip in a taxi, traditional hire car or rideshare service. This may be a time or distance based estimate, or a set amount, or a combination of these. This will bring greater transparency to the booked point to point transport market, making it easier for customers to shop around for a good deal, the Transport for NSW Spokesperson said. We received a wide range of insights and feedback on the proposed Regulation, with about 215 formal submissions considered, the Spokesperson said. The new rules give the industry the flexibility it needs to meet the demand of customers for greater choice in the point to point transport space, while continuing to meet safety standards set by the Government. Following the legalisation of rideshare in NSW in December 2015, the new Regulation underpins a modern safety regime in which service providers are accountable for the safety of their services. To help eligible taxi licence holders and hire car licence holders through the transition, an industry adjustment assistance package of up to $250 million is available and will be funded by a $1 levy per trip placed on all point to point transport providers, for up to five years. The temporary levy will start on 1 February 2018. During the public consultation on the proposed Regulation, stakeholders were overall supportive of the new safety standards, but they have requested guidance and support as well as a reasonable length of time to understand and comply with their new safety obligations, the Spokesperson said. Phasing in the start of the levy means all service providers have time to meet their safety obligations first, while getting systems in place to account for the levy. The new regulator for the industry, the Point to Point Transport Commissioner, will continue working with industry closely between now and 1 November 2017 to help ensure everyone understands their new obligations. The current passenger transport regulations and reforms in NSW has opened the market considerably to local and overseas competitors in order for the community to make their flexible choice in what mode of transport they desire to get from point A to point B. At present, taxis and registered number plates with authentic "HC' prefixed hire car vehicles & 'TV' plated vehicles are permitted to use the Bus Lanes throughout the Sydney Metropolita...n area, including the City bound, Bus Only Lane on Motorway # 2 from the Windsor Rd, Baulkham Hills intersection. However, when using Uber, for example, please be aware that the Bus Lane access is somewhat limited because it has discontinued the Uber Black/ Uber Lux/Uber SUV service (which HC/TV plated vehicles fell under) and now rolled them into Uber Premium with non-professional vehicles. So, for passengers travelling over Sydney Harbour Bridge from Sydneys Hills District, North West, Northern Suburbs and Northern Beaches or City bound travellers along Victoria Rd Inner Western Suburbs, you will no longer be guaranteed Bus Lane and Transit Lane access with a professional driver when making bookings with overseas based Booking Service Providers (BSPs). You stated we were irresponsible in our blockade, and you offered the "most generous" package of all the states. This is bending the truth to say the least. What you neglected to state was NO other state is seizing the assets of their citizens which you are doing. You also stated you consult with industry, allow me to ask with whom did you consult? In every meeting we attended we stated our distaste and what this means to 5000 families. You clearly HEARD NOTHING. Whilst we respect the office you hold as we are law abiding citizens, you have to date displayed NO RESPECT to the industry and those suffering, and continue to berate YOUR customers, as WE ARE YOUR CUSTOMERS. 15.01.2022 The NSW State Government is planning to recall all 'HC' prefixed hire car plates as from the close of business dated 30/06/20 so that, according to the bureaucrats, this will free up the existing bus lane usage. I had a meeting last month with 3 politicians at Parliament House, Macquarie St Sydney and I was amazed to hear that the said Govt. will also be considering to exclude taxis from using bus lanes too. These two actions by the Govt. will cause a huge inconvenience to th...e regular patrons of taxis & chauffeur driven hire cars. Customers will consequently be delayed in their travels during the lengthy peak periods around Sydney, where bus lanes are in existence & chauffeurs will not know for certainity if they will reach their next booking on time. This action by the State Govt. is very unreasonable & a restriction of our business practice to function properly & smoothly. Presently, hire car operators cannot expand their business by obtaining more vehicles registered with hire car (HC) plate numbers so that we may use the bus lane privileges. I seek public support to complain to the Point To Point Commissioner, Barbara Wise, to vent your views & disapproval of the Govt. proposals & protest vehemently that these actions by the bureaucrats will damage thousands of small businesses. 12.01.2022 NSW HCA Newsletter. Dear Members, As you would have all heard in the past week, the new P2P Regulation is now final and has been passed into law. Enforcement w...ill commence 1st November 2017. Every driver and operator is expected to meet all new obligations under the Regulations from 1st November. EDUCATIONAL SESSIONS The P2P commissioner, Barbara Wise, will be making time to meet with individual drivers/operators to run through obligations and answer any questions in a number of sessions planned around Sydney commencing September. NSWHCA directors will be attending the session on the 19th at the Novotel Brighton, as we thought that this would be the most popular session due to its close location to the airport. Transport for NSW have advised that they will not be answering questions regarding why things are the way they are or what has been passed into Regulation. Questions will be strictly limited to clarifications on how to proceed in line with the new Regulations. In order to be effective and ensure our questions are answered we will be making a submission of our questions to the Commissioner prior to that date. If she and her team are prepared they can move quickly through the responses as we only have 2 hours, or maybe even provide responses in advance and also help shape the presentations on the day. Please forward your questions to me on [email protected] and we will collate them and forward them to the commissioner. We will also circulate a copy of the consolidated questions document. We will stay behind after the session to answer any of your questions that relate directly to the NSW HCA and our efforts in trying to keep our plates beyond 2020. HCA STICKERS Please note, if you have NSW HCA stickers on your vehicles that is sufficient identification under the new regulation and you do not need any other form of PHV (Private Hire Vehicle) sticker. VIC & QLD PLATES DECISIONS We can inform you that VIC and QLD have decided to allow the drivers to keep their plates. This gives us hope for a similar outcome in NSW. FUTURE OF MOBILITY FORUM Ritta Khoury attended the Annual Transport and Tourism Summit "The Future of Mobility" on the 19th August and represented the HCA. There was an impressive line up of local and international speakers talking about transport infrastructure requirements into the future and how transport industries help shape the livability and functionality of cities. All global cities are commonly facing similar challenges in terms of exploding population and pressure on infrastructure. Emerging technology - both in how the public secure transport and the autonomy of vehicles - was a popular topic. One interesting theme that ran through all presentations and panel discussions was that governments have learned that they cannot stand in the way of progress (aka "disruptions") and are working to ensure they are part of the process in future. 04.01.2022 Tony Doufas to Victorian taxi and hire car families 3 Just now Ride-share giant Uber faces class action over Victorian operations TAXI and hire-car drivers... are preparing to launch a multimillion-dollar class action against ride-share giant Uber. Law firm Maurice Blackburn will today open a registration system for drivers and licence holders who believe they lost earnings as a result of Ubers conduct. The potential action would be based on allegations that the company acted unlawfully when operating in Victoria between 2013 and earlier this year, and resulted in loss and damages to taxi and hire-car licence holders and operators.The move follows similar action taken in Quebec, Canada, where taxi drivers are taking on the global ride-share operator for loss of earnings. Maurice Blackburns national head of class actions, Andrew Watson, said the firms current investigation was to confirm that unlawful action by Uber had occurred, and if enough taxi drivers showed interest in joining the action, then it may proceed. Its no secret that Ubers entry to the market has, in some instances, had devastating consequences, he said. Mr Watson said the case wasnt against the government or the regulator the Taxi Services Commission and whether law-breaking behaviour had been pursued. Registrations open today, with the Victorian Hire Car Association to be informed at its annual general meeting. VHCA president Rod Barton said drivers have been treated so unfairly since the arrival of Uber in Victoria. We are very supportive of Maurice Blackburn investigating the possibility of a class action against Uber regarding the way they entered the market in Victoria, he said. Uber has been on Melbourne roads since 2013, and allows passengers to book a journey through an app for an estimated fare. When it began operating, its drivers were not registered with a regulatory body, unlike taxis and hire cars, and the state government only created new laws only this year that covered the ride-share company. It also removed licence fees for taxis and hire-cars and forced those who provide a booking service for the use of a commercial passenger vehicle to be accredited. In response to industry anger about the value of taxi plates being destroyed, the government has promised owners $100,000 compensation for the first licence, and $50,000 for up to three other licences. A second round of legislation, which would deregulate the industry and allow taxi operators to set their own fares, is currently before State Parliament.
