24.01.2022 Retrospective Changes to Sunset Clauses for Residential Off-the-Plan Developments The Victorian Government has finally introduced a bill into parliament to prevent property developers from terminating off-the-plan contracts with purchasers that have passed their Registration/Sunset Dates. The legislation will require the developers to notify the purchasers and obtain their consent, before they may terminate the Contract. This proposed legislation moves in line with current NS...W legislation to protect purchasers, who have paid deposits and waited several years for developments to register, by preventing developers from cancelling those Contracts and then selling to subsequent purchasers at substantial increased prices. The legislation applies retrospectively from 23 August 2018. 20.01.2022 GST withholding by purchasers of new residential premises In a bid to prevent GST avoidance by developers, GST required to be collected for new residential property sales will now be paid directly to the taxation office at settlement rather than to the Vendor. If the margin scheme is to be used to calculate GST, the purchaser will withhold 7% of the purchase price at settlement and pay that directly to the taxation office. Developers will need to become aware of these changes... which will affect all contracts entered into from 1 July 2018. 14.01.2022 Attention all Real Estate Agents! A recent Court decision has held that a REIV Estate Agent Sales Authority is unenforceable because it did not comply with section 49A(1) of the Estate Agents Act 1980. In particular, it must comply with section 49A(4)(c), which outlines: (4) A rebate statement complies with this subsection if it is in a form approved by the Director and it contains ... (c) a statement that the agent is not entitled to retain any rebate and must not charge the client an amount for any expenses that is more than the cost of those expenses; and ... As a result, an agent may be sued for previous commissions and it would appear they would have no defence because the sales authority is unenforceable. Many agents who have used the standard REIV sales authority may look to sue REIV and Consumer Affairs to recover any lost commissions. We recommend estate agents contact the REIV and make enquiries as to whether the REIV will be updating their sales authority to include the above statement. If not, it would be prudent for all sales agents to include the above statement in all their Sales Authorities going forward. 05.01.2022 It appears the Metropolitan Melbourne Real Estate Industry will now be closed for 6 weeks. Without the ability to arrange 1 on 1 house inspections, the industry will virtually close for 6 weeks as prospective buyers will not buy existing houses without the ability of having an inspection. Rural Victoria however may still have inspections.
