In this case the tenants wanted to have a husky puppy in one of the Midnight apartments in Braddon. Where most expected that a no was a definite, this turned out not to be the case. The decision is validly based on the a logical interpretation of the amendment and should be used as guidance for future applications. The decision establishes that the onus is on the landlord to provide sufficient evidence of exactly how this particular animal will damage this particular residence at which point the tenant will need to provide tangible evidence to counter the landlords concerns. Factors of note in this instance are that; - The husky is currently a puppy and the decision does state that the apartment arrangement will not be suitable long term - The tenant was able to provide reasonable evidence of the puppy having lived in an apartment before with no incidence of damage. - The puppy was bred by the tenant's parents so it was not simply a matter of spontaneously acquiring a dog.
