Did you know that some contractors may be deemed employees for superannuation, workers compensation and payroll tax purposes? The most prominent differences are outlined below -: DELEGATION Unlike an employee, a contractor can delegate and pay someone else to do the work... REMUNERATION An employee generally is paid for their time whether it be per hour, per item, or a commission. If you are paying a contractor by the hour, check the other factors listed here, especially the last one, independence. A contractor is paid for a result based on a quotation. The quote can still be calculated using an hourly rate or price per item to determine the charge. Whilst a quote can be verbal, it would be ideal to be provided with a written quote. EQUIPMENT & TOOLS This category mostly applies to the building & construction industry. An employee would have equipment and tools provided for them or they would receive an allowance for providing their own. A contractor would supply most of the equipment and tools to complete the work and doesnt receive an allowance or reimbursement for this. RISK Who is responsible for the work and liable for rectifying any errors? Employees do not take commercial risks and they work under the umbrella of their employer. Contractors and legally responsible for their work and are liable to rectify errors. For this reason, contractors should hold indemnity insurance. INDEPENDENCE This is an important deciding factor. An employee does not carry on a business independently. A contractor operates their own business independent of the employers business. Independent contractors perform services as quoted or specified in their contract and are free to accept or refuse additional work. For payroll tax purposes, dont be fooled into thinking that just because individual contractor operating under a company name is providing a regular service to you that they are exempt from payroll tax. MYOB have taken it upon themselves in the 2020.2 update to restrict 2021 payrolls to only be entered when the system date is actually 1/7/20 UTC time (10am EST). This is what happens when software companies are out of touch with how professional users actually operate.
