25.01.2022 Something that we always do when we are dealing with estate matters is checking the Unclaimed Funds Register for any unclaimed money by the deceased. Unclaimed money is money from lost bank accounts, shares, investments and insurance policies. Although there are many reasons for money being lost, the main reasons are when you change addresses or simply forget about a bank account/financial investment/ insurance policy. The relevant institution at that point will then hand o...ver the funds to the government who will hold on to it until it is claimed by the rightful owner. Currently, there is over $1.1 billion dollars in unclaimed funds. If you do search the register and find that you have unclaimed funds, you will then need to follow the procedure to claim your unclaimed funds. You may or may not have unclaimed funds, but it is a free and simple search that may uncover funds that you have forgotten about. 09.01.2022 We are starting to receive inquiries regarding businesses experiencing financial difficulties for various obligations and we are assisting our clients with the best way forward. Recently the Government has considered temporary relief measures to assist businesses and individuals experiencing financial difficulties during the COVID-19 crisis . These temporary amendments assist debtors to avoid liquidation or bankruptcy and are as follows:... 1. In relation to companies, the Statutory Demand threshold has been increased from $2,000 to $20,000.00. The response time to a Statutory Demand has been increased from 21 days to 6 months. This will apply for the next 6 months with potential to extend and increase further. 2. In relation to individuals, the minimum amount to proceed with bankruptcy proceedings has been increased from $5,000 to $20,000. The response time for a bankruptcy notice is also increased from 21 days to 6 months. This will apply for the next 6 months with potential to extend and increase further. 3. Where a debtor wishes to enter into voluntary bankruptcy, the protection period (whereby creditors are prohibited from taking further action against the debtor) has been temporarily extended from 21 days to 6 months. This will also apply for 6 months with potential to extend and increase further. 4. In relation to insolvent trading, directors will be temporarily relieved of their duty to prevent insolvent trading with respect to any debts incurred in the ordinary course of the companys business. This will be relaxed for a period of 6 months to promote confidence between businesses to continue trade. However, this excludes fraud, dishonesty and criminal matters. Any debts incurred by the company will still be payable. These changes are expected to help those who are experiencing financial hardship to consider their options and repayment arrangements where possible. 01.01.2022 COMMERCIAL AND RETAIL LEASES After all the hype, why isn't the commercial/retail landlord/tenant negotiating the rent in good faith? Over the last few months, we have been subjected to media conferences, stories and articles about serious discussions between ministers of the Federal Government. After multiple meetings and strong rhetoric by the Government, some landlords and tenants still refuse to negotiate in good faith.... In fact, the manager for one of the largest landlords in Australia, sent out a letter to their tenants reminding tenants of their obligations. Tenants at the premises of that landlord floated the idea of closing their respective businesses in an attempt to protect their staff members and customers. The Landlord found out and promptly produced a letter to the tenants reminding them that if they were to close their premises, they would be breaching their obligations under the Lease. This move left the tenants confused that if they were to protect their staff members and customers, they would lose their premises. It is not only some landlords refusing to engage in good faith, but also some tenants, who possess a stronger bargaining power, are refusing to pay rent. We were contacted by a landlord of a property in a small country town who is afraid that if they evict the tenant (who has decided not to convert their cafe to take-away only but instead opted to not pay rent) they may not find a replacement tenant. So why are some landlords/tenants not following the code? The confusion lies in the fact that, although there was a National Cabinet meeting which came up with the 14-point National Cabinet Mandatory Code of Conduct, this has not yet been enforced. The code makes it clear that it is up to the states to enforce these Mandatory Codes of Conduct. New South Wales has set up the mechanisms required to make the laws applicable (as I have previously discussed), but has not yet enacted specific legislation to enforce the Mandatory Codes of Conduct. As of today, obligations and rights under a Commercial or Retail Lease remain as they were before the COVID-19 pandemic had started.
