We are a member of the National Advocacy Group on Women on Temporary Visas Experiencing Violence made up of over sixty state and national peak bodies, service providers and other organisations working to address violence against women across Australia. Together we have developed a comprehensive Blueprint for Reform to achieve safety for all ...women. Step 1: Improve the migration system so that all women on temporary visas who experience domestic, family and sexual violence and their dependants can access protections, services and justice. Step 2: Ensure eligibility and access to services and government support are based on womens needs for safety and recovery, regardless of their migrant status. Step 3: Ensure that women on temporary visas who have experienced domestic, family and sexual violence and their dependants have immediate and full access to safety, protection, justice and fully funded specialist support with demonstrated gender expertise and cultural competency. 07.01.2022 Women on temporary visas are ineligible for many government supports, such as housing and Centrelink, leaving many victims/survivors dependent on a perpetrator (partner or other family member) or with no income and with limited pathways to re-establish independence. Limited or no income, as well as immigration precarity, may force women to remain with a partner who is abusive and violent.... Ineligibility for social security also impacts womens ability to access social housing or concessions where proof of Centrelink eligibly is required. Women who are on a temporary visa and are experiencing domestic and family violence are also not eligible to access child subsidy. Lack of access to income and financial independence impedes womens recovery from experiences of violence and reestablishing her independence. It may also force women to return to partners who are violent in the absence of any other options to survive. 06.01.2022 Anna was 19 years old when she was forced to marry her husband, an Australian citizen, back in her home country. She came to Australia on a temporary partner visa, sponsored by her husband. Her husband the courage and opportunity to leave. She went to a family violence shelter and spent almost three months there - the longest anyone had stayed in that crisis accommodation. On average, people stayed there for 2 weeks... before they could find alternate options and move on. For Anna, however, finding an alternate option and arranging accommodation on her own was not a possibility due to her restrictive visa conditions. She was not eligible for income support or public housing. With much hassle, she managed to receive Special Benefits Payment from Centrelink but it was barely enough for her survival. With the help of some pro bono legal and migration advice, she applied for a permanent visa under the family violence provisions of the migration regulations. She had to wait long years before her application could be decided on, and was ineligible for most government supports throughout the long waiting periods. She suffered severe mental health issues and struggled to find employment. Having been forced to marry a violent man at the age of 19, she did not have sufficient qualifications or prior work experience to build her life from scratch in a new, unfamiliar country. All she wanted was to continue her life and do something for herself. Stories like this should not repeat. 02.01.2022 The experiences of domestic and family violence are similar for all women regardless of their migration status. However, ones visa status creates serious implications in the context of domestic and family violence and places women in vulnerable and often very precarious situations. Women on temporary visas who are experiencing violence face specific barriers to seeking support. These include:... - Risk, fear and threats of deportation - Risk, fear and threats of separation from their children - Limited social networks and access to support - Lack of understanding of their rights - Lack of knowledge of available services - Lack of English language skills - Community pressure to maintain a relationship - Financial dependence on the perpetrator - Inability to access income and housing Often perpetrators of violence use visas as another tool of control and coercion to continue inflicting violence on women.
