18.01.2022 Why You Need To Trust Your Attorney And To Choose Them Carefully! Don’t Be Like Linda! When you appoint an attorney to look after your affairs, you are giving them the power to make important decisions on your behalf. Depending on the type of appointment, such decisions can include selling your home, withdrawing funds from and/or controlling your bank accounts, putting you in a nursing home or deciding what type of medical treatment you are to receive. ... You need to be able to implicitly trust the person you give this power to! Unfortunately, there are many situations where the attorney is rogue, and things can go horribly wrong. This is Linda’s Story. Linda was living in a nursing home and relied on her daughter, Michelle, to manage her finances as her attorney under an Enduring Power of Attorney. In response to a request from a concerned family member, the Office of Public Guardian (OPG) investigated allegations that Michelle wasn’t paying her mother’s nursing home fees and was using her money in ways that benefited herself instead of her mother. The investigation found both allegations to be true and the OPG suspended Michelle’s financial powers as attorney for Linda for a period of three months. They also submitted an application to the Queensland Civil and Administrative Tribunal (QCAT) to appoint an administrator to manage Linda’s finances in the long term. The OPG also referred Michelle’s conduct to the Queensland Police Service’s Fraud Unit which charged Michelle with one count of fraud ‘dishonest application of property of another’. She was found guilty and sentenced to 18 months’ imprisonment, to be suspended after three months. She was also ordered to repay more than $25,000 to Linda (source: OPG Qld). 16.01.2022 Did you know the QLD Powers of Attorney and Advanced Health Directive laws are changing? Are you ready? As of 30 November 2020, the long awaited (almost 16 years) new and improved guardianship laws come into effect in Queensland. ... These are the laws which affect the guardianship system as a whole and will result in: - New Enduring Power of Attorney forms; - New Advanced Health Directive forms; - New other related forms and explanatory guides; and - New capacity assessment guidelines to assist those who have the power to assess an adult’s capacity to make a decision. This means from 30 November 2020, the new forms MUST be used, however they cannot be used before this date. Until 29 November 2020, the current forms remain in effect and are to be used.
