22.01.2022 It has been several weeks since Federal Cabinet told media it wanted to ban evictions due to rent arrears for tenants who have had their household income smashed by the thing. There has been a lot of chatter about landlords not being able to evict or authorise their agents to do it for them. There have been claims tenants no longer have to pay rent. As it stands the situation has not changed legally for tenants in private rental in Canberra. ... You can be served a Notice to Remedy when you fall more than 7 days behind in rent. If you don't remedy (pay $ owing), you can be served a Notice to Vacate (eviction notice). This may soon change. The ACT Assembly included the Residential Tenancies Act in its omnibus public health emergency legislation. This confers to Attorney General Ramsay the authority to amend the Act by regulation to support the objectives of the public health emergency. Chiefly, to provide for negotiations around rent reductions (tied to Land Tax Relief and to temporarily revoke Termination by Lessor provisions for rent arrears. Canberra Tenants are in touch with the AG to lobby for stronger measures and clarity for tenants. Legal Aid are the funded legal advice and assistance provider for private tenants in the ACT. They are hosting an online forum on COVID19 and renting from 6pm.
