25.01.2022 GRANDPARENTS & APPLYING FOR PARENTING ORDERS Are you a grandparent with the care of your grandchild? Have you been caring for your grandchild because their parent(s) are unable to?... Has your grandchild been temporarily placed in your care under a Guardianship of the Minister Order? You may have concerns about the safety and wellbeing of your grandchildren, or you may be prevented from having a relationship with your grandchildren. Many grandparents may not know that they can apply for parenting Orders for their grandchildren in the Federal Circuit Court of Australia. The Family Law Act recognises the importance of a child having a relationship with their grandparents and the Court has been clear that their paramount consideration is the best interests of the child. The child’s parents do not need to be separated for Orders to be made or for your Application to have merit. However, if there is a parenting dispute ongoing, you can make an Application intervening in those proceedings, as a respondent. If your grandchild is old enough to express a view, the nature and wishes of the child will bear some weight. It will be significant to your application whether the child is at risk of family violence or has been exposed to violence by a parent, whether there are addiction or drug or alcohol issues, criminal records or involvement with the Department for Child Protection or South Australia Police. The types of Orders you could seek as a Grandparent include That you have parental responsibility shared between you and the child’s parents, such that it allows you to make decisions for their long-term care. That the grandchild(ren) live with you That they ‘spend time’ with you and for how long That they are at liberty to communicate with you by telephone or FaceTime That you have guardianship of them.
