24.01.2022 An example of our regulatory system. The Occ Health and Safety Act in Victoria contains a number of checks and balances. WorkSafe can issue notices when a workplace is unsafe, and these will be part of our "admin law" framework, but ultimately criminal sanctions can apply. http://www.theage.com.au//builder-fined-over-fatal-fall-20

24.01.2022 See www.adminlaw.com.au for a new post on Kable, the recent High Court decision. This is a really important area of the law for administrators. Unlawful decisions do not tend to give rise to civil claims. But they can. Examples are when the unlawful decision involves physical detention of a person, or seizing property. Inspectors and authorised officers beware!!!

22.01.2022 Why is admin law like the third wheel?

16.01.2022 Back to the Water Company. Did you know Public Authorities often make decisions and assert their position without having real power to do so? In this case I asked the Water Company what statute gave them power to require me to extend their mains sewer at my expense. They referred me to something irrelevant. Turns out they don't have that power after all! Aways good to go back to the source...

09.01.2022 Did you know government agencies may exercise power without thinking about whether they actually have that power? Case in point. A block of land in the country. A Water Company. A local council. Water Company and Council seem to think they can require land owner to extend the mains sewer over 25 metres to service the block at the land owner's expense. And I mean expense - over 25k!!! Watch this space...

09.01.2022 And here's another example of our administrative law at work. Bullying in schools and the ability of the school to expel a student? This article doesn't explain the regulatory context, but it looks like admin law to me! http://www.theage.com.au//dispute-over-bullying-could-affe

03.01.2022 It never gets old, this advice. But to many of us it's a new thing. How often do we rely on what our peers tell us legislation means? How often do we rely on our organisation's policies about the law? This advice from a High Court judge to advocates is equally applicable to anyone who regulates or works with regulators! http://www.adminlaw.com.au//good-advice-for-those-in-gove/
