23.01.2022 At its very heart there are two principles behind all children’s decisions in the family law courts. They are set out in section 60 CC of the Family Law Act: The primary considerations are: (a) the benefit to the child of having a meaningful relationship with both of the child's parents; and... (b) the need to protect the child from physical or psychological harm from being subjected to, or exposed to, abuse, neglect or family violence. 20.01.2022 I just had a client ask me about a cheap divorce option hed found online. He asked me how much a divorce cost and I told him that he has to pay the filing fee which, I looked up for him and it was $900. He said hed found somewhere he could do it for about $120 online and wanted to know whether it would be effective.... I explained that only the court could make a divorce order in Australia. He provided me with the website which does advertise $118 divorce application. Further investigation on the website and a click on important facts reveals that you will also have to pay $900 filing fee to the court itself. So you would be paying $118 to fill in a divorce application form, which you can do online, to people who arent lawyers.

08.01.2022 Coffs Harbour Credit repair business, Clear Credit Solutions Pty Ltd (Clear Credit) has paid penalties of $21,600 after ASIC issued two infringement notices. 1. Clear Credit said they could determine from reviewing a consumer's credit report, whether it could remove negative listings from that consumer's credit report. ASIC considered that these statements were false or misleading, as negative listings can only be removed in limited circumstances and that removal of the listing cannot be determined from simply reviewing a consumer's credit report. 2. In November 2016, Clear Credit also stated on its website that it was "voted Australia's most trusted credit restoration service". ASIC considered that this statement was false or misleading as no such voting process had taken place.

Lenders will only allow a certain number of credit enquiries to be recorded on your credit file. Currently, it is about four within the last six months or six within the last 12 months. Any more enquiries will result in an automatic decline of the application.... You should be clear as to what constitutes a credit enquiry, as Equifax says: Every time you apply for credit and a credit provider obtains a copy of your report, an enquiry is added to your credit report. This includes any loan, mortgage or utilities applications you may make. There are steps the lenders need to take before they can list the credit enquiry on your credit file. If you are online and clicking buttons as you go, you may have given the financier permission to report you. We have had clients who did not realise they were making enquiries that would be listed on their credit file. They thought they were just looking into possibilities with various lenders online.

01.01.2022 Recent developments in the Federal Court suggest a plea deal of some sort between the ASIC and Malouf Group Enterprises Pty Ltd (MGE) and Jordan Malouf (Mr Malouf). On 19 February 2018 the parties agreed to vacate the trial dates and instead list it for final orders by consent on 23 April 2018. We dont know what orders are being sought yet but there are some clues:... 21 days prior to hearing Mr Malouf is to file and serve information about the financial position of himself as well as MGE; 21 days prior to hearing the ASIC will provide evidence from, among others, credit reporting bodies Equifax and Dun & Bradstreet and also from the ASIC. This suggests that the court will need to know what the financial position of the defendants is, which is really only going to be of interest to the court if its looking to impose a financial penalty. All will be revealed by 23 April.
