08.01.2022 Updates on 485 PSW visa for International Students. *************************************************************** Yesterday the law has changed regarding the inability of those who have held a 485 visa before cannot apply for a second 485 visa unless you have studied and worked in a regional area in relation to extending your 485 visas... This means if you have held a 485 visa previously as a dependent on your partner's 485 visas, you will not be eligible to apply for your own 485 visas as a primary applicant. The current law as of today reads; 485.211 The applicant: (a) has not previously held a Subclass 476 (Skilled Recognised Graduate) visa that was granted on the basis that the applicant satisfied the primary criteria for the grant of the visa; and (b) has not previously held a Subclass 485 (Temporary Graduate) visa in the Graduate Work stream; and (c) unless the applicant has nominated the PostStudy Workstream in the application and meets the requirements of clause 485.232 or 485.233has not previously held a Subclass 485 (Temporary Graduate) visa in the PostStudy Work stream; and (d) has not previously held 2 Subclass 485 (Temporary Graduate) visas in the PostStudy Workstream. Yesterday it read like this; 485.211 The applicant: (a) has not previously held a Subclass 476 (Skilled Recognised Graduate) visa that was granted on the basis that the applicant satisfied the primary criteria for the grant of the visa; and (b) has not previously held a Subclass 485 visa that was granted on the basis that the applicant satisfied the primary criteria for the grant of the visa. So you can see the difference is quite dramatic. The old law only stops 485 primary visa holders from applying another 485 as primary applicant again. The new law now stops all 485 holders, primary and dependent, from applying for another 485 visas as the primary applicant, unless you are applying for a 485 extension based on meeting the requirements of regional study and residence.
