13.01.2022 UPDATE on Subclass 300 Processing The Department of Home Affairs has provided a the following response regarding enquiries about Subclass 300 Prospective Marriage Visa Applications. The Department continues to process visa applications. Its current priority in the Offshore family program is finalising applications from immediate family members of Australian citizens and permanent residents which meet all requirements for visa grant.... Take note that holder of Subclass 300 visa grants are not necessarily deemed immediate family members and their requests are considered on a case by case basis. A person’s intention to marry their fiancé is not sufficient, in and of itself, to satisfy the definition of de facto partner. If a Prospective Marriage visa holder considers they meet the definition of immediate family (eg because they are actually in a de facto relationship, or they are the parent of a minor child who is an Australian citizen or permanent resident) they should provide evidence of the relationship through the exemptions form and, if accepted by the Department they will be recorded as exempt. If they are not an immediate family member they can apply to be granted an exemption on the basis of compelling or compassionate circumstances. Need help with your visa? Contact us. 05.01.2022 Another GOOD NEWS! CONGRATULATIONS to our client for another VISITOR VISA GRANT! The rise of Covid-19 has impacted the lives of everyone in many ways we could not have predicted. The challenge in this application is that the applicant was a holder of a visitor visa with a condition not to stay in Australia for more than 12 months in any period of 18 months. ... Also, the client was unable to leave Australia due to flight cancellations, she was in danger of breaching this condition.
