25.01.2022 What is Mediation? Mediation is a means of resolving disputes without the need to engage lawyers for the purpose of litigation (court). It is a process that enables parties to a dispute, that have difficulties with effective communication, to communicate in an effective and productive manner. These difficulties with communication can arise for several reasons such as deep emotional involvement, clash of personalities, negative history or even hatred. 16.01.2022 How long does the Mediation process take? Mediations can take as little as 2 hours or as long as a week depending on the complexity of the dispute. It has been recommended by the Australian Mediation Association that mediations should not go longer than a half day at a time or 4 hours. This is because most people can become mentally fatigued or drained after this amount of time. However, this is generally an ample amount of time for most mediations to reach a resolution. If t...he complexity of your dispute requires more time, we recommend breaking the mediation into 2 half day sessions to maximise productivity and to reduce stress. This will of course be made clear during your intake session to ensure there are no hidden surprises or costs. Once an agreement has been successfully negotiated an ‘agreement in principle’ is signed by both parties. This gives both parties peace of mind while the official deed is being drafted.
