22.01.2022 ACT Updates Critical Skills List The ACT (Canberra) released an updated Critical skills list today. This is the relevant list for ACT Subclass 491 and Subclass 190 State Nominated visas. If you have applied earlier for a nomination and your occupation has been removed, your application will not be progressed and will expire after six months according to the ACT State Nomination authority. Of note, some construction occupations have been added. The first round of invitations will be issued on 15 January 2021, and there are only 552 Subclass 491 nomination places and 452 Subclass 190 nomination places available for the remaining period of the 2020-2021 program year. 21.01.2022 PLAN TO ALLOW SUBCLASS 309 (Offshore Partner Visas) TO BE GRANTED ONSHORE!! The Australian government will introduce new legislation which will allow Subclass 309 Visa applicants to have their partner visas granted while they are in Australia. This means that visa applicants will not have to leave Australia to have their Subclass 309 visas granted, as is the requirement at the moment. According to the government, this is a temporary measure during the COVID-19 pandemic. 17.01.2022 WHAT IS FUNCTIONAL ENGLISH As discussed in our post below, from mid to late 2021, "Functional English" will be required for partner Visa applications for the visa applicant, and the sponsor where the sponsor is a Permanent Resident and not an Australian citizen. We anticipate that certain passports will be exempt, as currently, the following passports are exempt from English requirements - UK, US, Canada, Ireland and New Zealand. Have a look at the Department of Home Affair...s website below for a further explanation of what constitutes "Functional English". It may be worthwhile to consider getting started with your Partner Visa applications before you are saddled with having to do English tests or, having to pay the extra fee for the sponsorship application, which apparently will be $420 extra on top of the already eye-watering Partner Visa application fee. People will be able to demonstrate this through, for example, the completion of 500 hours of free English language classes through the AMEP. 09.01.2022 ETA (Electronic Travel Authority Trial) The Department of Home Affairs is trialling an Electronic Travel Authority (ETA) mobile app (AustralianETA) for some ETA-eligible passport holders while the travel restrictions are in place. You can apply for an ETA through the app if https://covid19.homeaffairs.gov.au/i-want-apply-visa:... Qualifications: you meet all ETA eligibility requirements and you hold a passport from Brunei, Canada, Hong Kong (SAR of China), Japan, Malaysia, Singapore, South Korea or the United States of America. Before you can travel on an ETA, you must also be exempt from Australia's travel restrictions. Grant of an ETA through the app does not mean you have been considered for or granted an exemption to travel to Australia. You still need to apply for a travel exemption and provide evidence to support your claims. If you are not granted an exemption, you should not continue with your travel plans, as you will not be permitted to board a flight to Australia. Use of the Australian ETA app incurs a non-refundable service fee of $20. An ETA does not allow you to work in Australia, or stay longer than three months. 06.01.2022 VISA GRANTS & "FIRST ENTRY DATES" We are still getting lots of questions about "first entry dates", in relation to Visa grants. 06.01.2022 WORKING HOLIDAY MAKER CHANGES Australia's Prime Minister Scott Morrison has announced that there will be (good) changes to the working holiday Visa program to assist farmers with their crops. According to the press release, the government will "remove conditions on visas used by working holidaymakers and other foreign nationals that would ordinarily force them to return home". Also, "the age limit of 30 on the working holiday Visa will be scrapped, so people aged 31 and olde...r could continue working in agriculture". Some farmers are currently in dire straits because of the border closures and a significant reduction in working holiday makers being able to work as backpackers in regional areas in agriculture. There are stories of farmers ploughing crops back into the soil because they simply cannot find workers to assist with harvests. The formal announcements with respect to the working holidaymaker changes will apparently take place next week after the Budget on Tuesday 6 October. 05.01.2022 PROSPECTIVE MARRIAGE VISA UPDATE As many of you already know, the Subclass 300 Prospective Marriage Visa, is valid for nine months, and allows the Visa holder to travel to Australia to marry their fiancé. Unfortunately, the pandemic has ruined many Prospective Marriage Visa holders' plans to travel to Australia and get married.... The government has clarified (to some extent at least) the situation for Prospective Marriage Visa holders who are stuck overseas because of the travel bans. REFUNDS Visa application fee refunds will be available to Prospective Marriage Visa holders who have been unable to travel to Australia because of the COVID-19 bans, and whose visas have expired. According to the government, refunds will enable an applicant to reapply for another Prospective Marriage Visa once the travel bands are lifted, and there is also a promise that the new applications will be prioritised.
