09.01.2022 Just recieved a fantastic ruling from the Australian Taxation Office. The ATO agreed that should a mortgagor re-purchase their property (which has been sold at a mortgagee auction) then there is no taxable supply.

07.01.2022 The Personal Property Securities Act 2009 (Cth) (PPSA) has changed the function of the Retention of Title (Romalpa) clauses. Some of the relevant changes are: - the attachment and perfection of the security interest is what makes said interest enforceable (rather than the retention of title); - Under the PPSA this can be done by registering a Purchase Money Security Interest (PMSI) that defeats other perfected security interest;... - An unregistered interest is not binding upon insolvency; - The security interest may become extinguished upon the sale of the goods to third parties.
