21.01.2022 By majority, the High Court overruled the previous Federal Court decision (handed down in August last year in relation to Mondelez Australia Pty Ltd v AMWU) where it was controversially decided that an employee’s entitlement to personal/carer’s leave would be expressly ‘calculated in working days, not hours.’ The High Court’s determination has taken us full circle and we are back to calculating personal/carer’s leave on the basis of ordinary hours of work, however calculating this across a yearly period. 21.01.2022 The 2020 Annual Wage Review has resulted in a decision by the Fair Work Commission (FWC) to increase the national minimum wage and the minimum award rate by 1.75%. The new national minimum wage, which applies to all full-time and part-time employees, who are not covered by an award or agreement, will increase to $753.80 per week or $19.84 per hour (before tax) from 1 July 2020. The Fair Work Commission has also increased minimum pay rates in the modern awards by 1.75%. ... This is a significantly lower increase from the FWC, in comparison to recent years. Although employer groups argued for a wage freeze, the FWC took into account the effects that COVID-19 has had on the Australian economy, and therefore decided on a phased implementation of the increase across different groups of awards. 17.01.2022 Further to our announcement regarding the new 1 July employee eligibility test date for the JobKeeper Payment, the Australian Government passed the JobKeeper Extension Scheme through legislation on 1 September 2020. The passing of this legislation brought with it changes and extensions to the JobKeeper provisions in the Fair Work Act, with extended provisions coming into place from 28 September 2020 and extending to the end of the scheme on 28 March 2021. The provisions intr...oduce the Legacy Employer, which is further explained below. The JobKeeper provisions in the Fair Work Act will continue to provide employers with the flexibility to manage their employees, dependent upon the effects that COVID-19 has had on their business in relation to turnover.
