21.01.2022 There’s no set rule about how much notice employees need to be given for roster changes it will depend on the rules in your award, enterprise agreement or emp...loyment contract. So if your boss is changing your roster, that’s the first place you should look to check your entitlements. For example, under the Restaurant and Hospitality awards full and part-time employees must be given at least 7 days’ notice of a change (unless the employee agrees otherwise). FACT: It’s unlawful to pay less than the minimum r...ates from the worker’s award or enterprise agreement. So your boss is breaking the law. It’s also unlawful to be paid off the books so you don’t get super or pay tax as required. Myth 2: Employees don't need to be paid for time spent opening and closing a business. FACT: Employees must be paid for all hours they dedicate to work. For example, if you’re required to be at work at 7.45am to set up for an 8am opening, you need to be paid from 7.45am. Myth 3: Paying employees with food, drink or store goods is OK. FACT: You need to be paid in money for all the time you work. Myth 4: Pay slips aren’t mandatory employers only need to give employees pay slips if they ask for them. FACT: Every worker needs to be given a pay slip for every pay day. We also recommend keeping your own record of when you work too, so you can check you’re being paid accurately. Keeping your own record can help you raise and resolve any issues early on. 10.01.2022 The JobKeeper provisions in the Fair Work Act have been extended to continue past 28 September 2020, with some changes. One of the changes is that qualifying em...ployers can no longer use the original JobKeeper provisions to make agreements with eligible employees to take annual leave at half pay, or make requests (which employees couldn’t unreasonably refuse) that employees take some annual leave. From September 28, any agreement to take annual leave that was made under these provisions stops applying. After this date, the usual rules about taking annual leave apply. Your award, enterprise agreement, employment contract or workplace policy may set out how to take annual leave, including if employees can be directed to use leave. Any addit...ional hours worked need to be reasonable, and you can refuse to work unreasonable additional hours. If the only reason for a request to work additional hours is to ‘match’ the amount of the JobKeeper payment, that is not likely to be reasonable. Your employer also needs to comply with any other terms and conditions of employment that apply to you (like the rules from your award, enterprise agreement or employment contract). Your employer must pay your usual base rate of pay for the additional hours, as well as any penalty rates or overtime pay that may apply.
