09.01.2022 How to avoid liability for your employees’ illegal downloads The Federal Court recently made a landmark decision that will require six Australian internet service providers (ISPs) to disclose the identities of customers who illegally downloaded the movie Dallas Buyers Club. Approximately 4,700 people are expected to receive demands for compensation from the filmmakers. For employers, this may raise concerns. Is it possible that your employees are illegally downloading at work...? If they are, you may be liable under the Copyright Act 1968 (Cth). Your liability will depend on whether you have authorised the copyright infringement. Factors that a court will look at when determining whether you have authorised an infringement include: the extent of your power to prevent the infringement; and whether you took reasonable steps to prevent it. As an employer, what you can do to both prevent illegal downloading in your workplace and reduce your liability for any infringements that do occur? The best way to show that you have taken reasonable steps to prevent illegal downloading in your workplace is to have a good policy in place. To protect your business from liability, ensure that your internet usage policy does the following things: details the activities that that are banned under the policy; includes a specific term that prohibits illegal downloading, e.g. ‘The Company does not allow the use of company computers or internet for any illegal activities, e.g. illegal downloads'; allows you to discipline employees who illegally download at work (state that employees may face disciplinary action for failing to comply with the policy, and remind employees of the wider consequences of illegal downloading); and allows you to monitor employees’ online activity. What you need to know about monitoring employees’ online activity If you need to monitor employees’ online activity to ensure compliance with the policy, make sure that your policy explains how this will be done. Include information about: what web browsing is logged; who can access the logged information; and when logged information may be disclosed. Under legislation in NSW, WA and the NT, it is illegal to monitor employees’ online actvity unless: you do so in accordance with a workplace policy; employees are notified about the policy; and you can reasonably assume that they understand it.
