18.01.2022 Can a Will be challenged by a relative, family member, spouse, former spouse or a dependent? The simple answer is: yes. Despite what the Will says, an eligible person can challenge the validity, or enforceability, of a Will if they are left out from it. ... 16.01.2022 A guide to having a baby, taking leave and returning to work: It is against the law to discriminate against someone because they are pregnant, or potentially pregnant. This occurs when someone is treated less favourably than another person because they are pregnant or potentially pregnant. That is, for example, transferring the employee to another job, being overlooked for a promotion, or dismissed. ... Under the National Employment Standards in the Fair Work Act 2009 (Cth), all employees that have worked for their employer for at least 12 months before the date or expected date of birth or adoption and have or will have responsibility for the care of a child are entitled to up to 12 months of (unpaid) parental leave. Employees may be eligible for 18 weeks of government-paid parental leave under the Australian Government Parental Leave Pay Scheme. An employee who has been on unpaid parental leave is entitled to return to the position they had prior to taking leave. If an employee’s position no longer exists, the employee is entitled to return to an available position for which they are qualified and suited nearest in status and pay to the position they had prior to taking leave. https://alsarraylawyers.com.au/ #alsarraylawyers #Parramatta
08.01.2022 To Vax or not to Vax, that is the question. Tomorrow 22nd of February is the vaccine's first rollout in Canberra. Is it safe? Will it be compulsory? These are... questions on almost everyone's mind. Here's an article I wrote addressing these questions: https://alsarraylawyers.com.au/covid-19-vaccination-timeli/ #alsarraylawyers
07.01.2022 Have you ever heard of the term 'Buyers Beware'? I have encountered many clients who are willing to spend literally millions of dollars on residential or investment properties but who are not willing to spend a few hundred dollars more on legal or accounting advice. Here's a bit of background - a vendor is required to "disclose" what is called 'prescribed documents' in a contract which may or may not have critical information about the property in question (information so cr...itical that not knowing them may be hugely detrimental). But often times, such information is buried deep within the voluminous contract, or hard for a lay-person to understand. So, what does it mean to give a 'Buyers Beware' warning: it means the vendor has to disclose the documents or information in the contract and it is up to the purchaser to do his or her own enquiries and investigations. This is often represented in those attending auctions and bidding on properties without knowing what is in the contract or doing investigations about those properties. 01.01.2022 Big changes are coming about to Australian Domain names rules. When it comes to trademarks, users have been relying on the 'close and substantial connection' rule to protect their domains. From 12 April 2021, a domain will be registrable only if the business has a trademark that is a 'match' to the domain. This change will apply retrospectively. This means existing domains may be subject to cancellation. ... 01.01.2022 Solicitors are sounding the alarm on dodgy and unenforceable Wills Solicitors are urging clients to revisit their wills following an increase in Wills preparation during the pandemic that is deemed to be unenforceable. The COVID-19 Pandemic has caused a wave of panic estate planning, with many Australians rushing through the process of Wills preparation. This, unfortunately, resulted in Wills not meeting the mandatory requirements in order to be deemed valid. ... We are urging those who hurried to draft a Will during the pandemic to revisit their Wills. Such missed requirements include the requirements for independent witnesses, establishing capacity of the testator, and properly capturing the intentions of the testator. https://buff.ly/3w6HeLv #alsarraylawyers #Wills #Parramatta #Smithfield
