25.01.2022 Theres no excuse for paying workers a flat rate that undercuts the minimum entitlements or trying to hide it with unlawful off the books practices. Followin...g our legal action, the Courts have handed down penalties of $243,000 against the operators of several fruit and vegetable and flower stores for underpaying workers, non-compliant record keeping and falsifying employment records. Between 2012 and 2014, the company underpaid three workers $132,956 through the use of varying flat rates of pay of between $10 and $18.52 per hour. All underpayments were rectified following the commencement of our legal action. Accurate and timely record-keeping is a fundamental obligation of any employer and whenever we find false records we will consider court action, with increased penalties now available. 17.01.2022 Under the Fair Work Act, your boss can ask for evidence when you take paid sick leave, even if you were only off work for a day or less. So what counts as evid...ence? There are no strict rules, but it needs to convince a reasonable person that you were sick. And while an award or enterprise agreement can say what type of evidence employees have to give, the type of evidence requested must always be reasonable in the circumstances. So, for example, if youre generally required to provide a medical certificate when youre off sick, but you couldnt get an appointment to see a doctor to ask for a medical certificate, you could provide a statutory declaration instead. 06.01.2022 Youre entitled to be paid for all the time you work. This means if youre required to come in 10 minutes early or stay back late to count the till or clean, it... should be paid time. And you shouldnt be asked not to clock on yet if youre working or to clock off early so you arent paid. So if youve been finding your pay packet is always a bit light because your boss rounds down your hours to the nearest 15 or 30 minutes or asks you to work off the clock, know this isnt ok.
