25.01.2022 The purpose of this petition is to ask the Minister to not approve the amendment to the planning scheme C153. This is the mechanism that the council needs to place a public acquisition overlay on the land to compulsory acquire the land for public use. The current land owners are 77 years old and had a building permit approved by the same council to build a dwelling for their first home for their retirement. ... 1 month later the council made contact to purchase the land and if they could not come to an agreement on the purchase price that they would take it by compulsory acquisition. The land is known as the carnival site but Infact it is the only place of residence to the land owners and their 2 children and their children! ( 3 families). The family’s business is amusement rides and spends the year supplying amusement rides to The Agricultural show circuit and major events and festivals around Australia, including the Sydney Royal Easter show, Brisbane Ekka, Moomba, Santa’s Wonderland Adelaide to name just a few. The property in Cowes is their only home address and the family retreats there for the Dec January peak tourist time and then stays until April and the children attend the Cowes Primary school for the first term before returning to the show circuit where the children then attend the National School for travelling show children. The council plans to change the land for public purposes and development the space as a recreational hub. This is a great initiative and the community will greatly benefit from this plan. However the council did purchase 40 acres from the current owners next door in 2011 known as the Hilton Chadwick reserve and has not developed this or opened this up to the community as open space or dog walking grounds. Why can’t they build this aspirational plan on land that is for sale? Why can’t they compulsory acquire the land on the other side of the Hilton Chadwick reserve and leave the current land owner with part of their land?
