20.01.2022 In a high value commercial dispute, a defendant may engage one expert witness as an advisor to the law firm on how to run the case and a separate expert to act as an independent expert. The advisor who understands the animal factors is providing expert assistance on strategy whereas the independent expert is providing expert evidence only. We have found that law firms often appreciate suggestions from the advisor expert witness ( so called "dirty" expert ) on what questions should be answered in a report produced by the so called "clean" expert.

There were solicitors who were interested in getting an opinion for someone independent, on not just relating to horses and people that excellence. 10.01.2022 What is allowed in preparing an expert witness for the court experience? In Australia, there is one case which seems to adopt a conservative view at least in the context of rehearsing cross examination with witnesses generally. In the NSW case of Re Equiticorp Finance Ltd; ex parte Brock [No 2] (1992) 27 NSWLR 391 at 395, his Honour Justice Young stated: In ordinary litigation there are very severe limits, in the interests of justice, in preparing a witness to give evidence. ... Some matters of preparation are clearly in order, and some are clearly out of order, but it is not always possible to state general rules as to where the line should be drawn. It is clear that a witness might confer with his or her solicitor or counsel, or the solicitor or counsel for the party calling the witness, and that during such conference the solicitor or counsel concerned may give the witness advice. That advice may certainly include: * advice that the witness should refresh his or her memory from contemporaneous documents; * directing the witness mind to the point about which questions may be asked; * giving the witness a sketch of Court procedure; * directing the witness attention to points in his or her evidence which appear to be contradictory or fantastic; * reminding the witness to bring to Court all relevant documents; * advising the witness as to the manner of answering questions (eg In cross-examination listen to the question, just answer the question asked with as concise an answer as possible); and * giving advice as to appropriate dress and grooming. 06.01.2022 Most of the time if it takes us less than 3 hours to identify an expert for a particular matter and this service is free. A "suitable expert " is someone who has the expertise, is not conflicted because of associations with the plaintiff or defendant and can get it done within the deadlines the solicitor is asking for. Occasionally we are asked to find an expert who is not already on our panel and the request requires us to go interstate or overseas to avoid getting someone who is not conflicted. In this instance, there may be a fee to find the right expert, especially if a lot of staff time is involved
