Depending on the offence and outcome, your licence will either be suspended or cancelled (unless there is a defence open to you). The cyclist approaches a car who is indicating left and about to commence a left hand turn into a driveway - Who must give way? ... The car to the cyclist, or the cyclist to the car? Short Answer: The cyclist must give way to the car. Regulation 141(2) of the Road Safety Road Rules 2009 states that a rider must not ride past, or overtake, to the left of a vehicle that is turning left and is give a left change of direction signal. According to the Structure and Language of the Regulations, a driver who is 'turning' refers to a driver who is preparing to make the turn, as well as a driver in the course of making the turn.
