16.01.2022 The duty of a trustee You could be appointed as a trustee of someones Will or an Attorney under a Power of Attorney. These are positions of trust. Generally, a trustee is not paid. With your property, you can do what you like with it: you can sell it or spend it at the casino. But where the property is trust money, you must only act in the best interest of the trust and not in your own interest. For example, We had a situation where a Mother had appointed her Son to be his A...ttorney. He thought that she would die in the next 20 years. He wanted money urgently because he wanted to renovate his house now. He decided to help himself to some of his mothers money. He justified the situation by saying that the money would be his eventually, he required the money now and, besides, what was his Mother going to do with the money in the meantime anyway. If she spent the money before her death, then he would get less. The Son did not consider factors like spending on aged care services, home support, the cost of pharmaceuticals and other health care services. His cousin made an application to the Victorian Civil and Administrative Tribunal (V.C.A.T.) and his trustee power was taken away from him. He may of even received a summons to Court to repay the money. See more

14.01.2022 WHY DO I NEED PROBATE? Probate is a process undertaken by the Supreme Court. The Court has 2 tasks. What document or documents constitute the last Will, if any? Who is entitled to be the Executor or Administrator of the deceaseds estate? After Probate or Letters of Administration is granted by the Supreme Court to the Executor or the Administrator, that person can then administer the Estate. This involves identifying what assets are in the estate, collect and gather the ...property and possessions; pay any outstanding debts, including funeral expenses; hold property in trust, where applicable and distribute the estate to the beneficiaries. In order to collect the real estate and funds held with financial institutions, a grant of Probate of the Will or Letters of Administration of an intestate estate is required from the Supreme Court. This grant must be produced to each of the authorities and financial institutions, such as life estate, superannuation, share brokers, banks and the Titles Office to sell or transfer a real property. So, the Grant is proof that the person named in the Grant is entitled to collect and distribute the estate of the deceased.
