19.01.2022 Small business owners are demanding to retain the Innovation Patents system, a scheme giving an efficient and cheaper way of protecting incremental trademark innovations for a period of 7 years. Although IP Australia - Official has argued that this second-tier patent scheme does not offer protection on the level of standard patents, SMEs are concerned about exposure to risks if the scheme is abolished with no alternative plans proposed. 15.01.2022 COVIDSafe Update: the Federal Government has just introduced legislation that makes it a criminal offence and an interference with privacy for the purposes of the Privacy Act to mishandle COVIDSafe Data. The Privacy Commissioners office issued a statement that COVIDSafe app data can only be used for purposes related to contact tracing and must be stored in Australia and destroyed when the app is no longer required. In addition to investigating any complaints or breaches re...lating to the App, the Commission in mandated to proactively assess the system to identify any privacy risks and has [been given] expanded powers to compel information and documents in order to do this. 08.01.2022 Australias first privacy class action was settled last week, with 108 NSW Ambulance workers to receive payment due to a major data breach of their workers compensation files. In 2016, over 100 medical records of current and former employees unlawfully accessed by an NSW Ambulance contractor that was on-sold to personal injury lawyers. Justice Ward awarded a $275,000 settlement sum last Monday, serving an important lesson to businesses about the consequences of poorly managing private data breaches.

Plush, Koala Living, Early Settler and OzDesign Furniture paid a $12,600 fine after advertising statements including was $2599, now $2049 where the was price was never recommended retail price. 05.01.2022 Fintech companies are demanding for a more competitive R&D tax program seen in neighbouring countries such as New Zealand and Indonesia, to keep their businesses in Australia. Over 78% of Fintech companies already access the tax incentive schemes, however, the government proposal to tighten these policies are disincentivising prospects for future innovation. It will be important to track how policymakers intend to enhance the global competitiveness of the Australian technology industry.
03.01.2022 An IT contractor of leading property valuation firm LandMark White has been refused bail for several counts of data breaches, uploading the personal information of 275,000 people to the dark web. The case against the offender was considered by Magistrate Greenwood as very serious indeed, where in some breaches included leaked drivers licenses, costing the firm up to $8 million in losses. In 2019 alone, LandMark White had suffered from two major data breaches resulting in a temporary suspension from the ASX as well as suspensions from major banks CBA, ANZ and NAB. With the case returning to court on 17 October, it will be interesting to see how the court responds towards mitigating serious counts of data breaches. #DataBreach #Privacy #DataProtection
01.01.2022 The ACCC is suing Google in the Federal Court for alleged false claims about what personal location data it was collecting for users with Android mobile phones and tablets. ACCC chair Rod Sims spoke about Google collecting highly sensitive information without consumers being able to make an informed choice. Noticeably, it is the first major court case the ACCC has launched following its inquiry into Digital Platforms released in June 2019.
