19.01.2022 Planning and Development (Extension of Time) Amendment Bill 2014: The proposed amendments announced act as a stimulus package for the ACT construction and building industry. The amendment to the current laws seeks to change the extension of time (EOT) system. The new EOT system will include a reduction of fees charged on blocks where not developed within time frames specified in their crown lease. The fee system will amend the current fee structure and replace it with a... simple and straight forward system, now calculated from the 4th year of extension. The reduction of the EOT fees will encourage the completion of construction and building developments by reducing the developers financial burden. EOT hardship provisions will be introduced allowing a reduction of fees, while encouraging completion. Further amendments to Crown Leases will dispose of commencement clauses and fees for its breach, on the condition that completion dates be abided. This allows for situations where developers may need more before the commencement date due to factors such as building and financial requirements. See more

16.01.2022 The 2014-15 Budget released on 13 May included a number of important Immigration changes. The 2014-15 Migration Programme will provide a total of 190,000 places, including 128,550 Skilled Stream places, 60,885 Family Stream places and 565 Special Eligibility Stream places. With the reprioritisation towards employer sponsored visas, employers will be assisted in finding workers to fill vital positions where they have been unable to find local workers. This also protects Austr...alian workers, who will have less direct competition from independent migrants who arrive without a guaranteed job, Scott Morrison, Minister for Immigration and Border Protection said. The main concern of the 2014-15 Budget is that the Other Family Stream (Remaining Relative, Aged Dependent and Carer visas) and Non-contributory Parent visas will be closed to new applicants. The Family Stream will focus on meeting the increasing demand for close family reunions so that the additional partner and child places are made. 15.01.2022 Every year on 1st July, the Skilled Occupation List (SOL) is updated by the Department of Immigration and Border Protection. You must nominate an occupation from the SOL list and pass the skills assessment in order to apply for a Skilled Independent Subclass 189 visa or a 485 visa in the Graduate Work Stream. The DIBP has not yet announced the new Skilled Occupation List for 2014. But the Australian Workforce and Productivity Agency (AWPA) has flagged a number of occupations... which were borderline in terms of their inclusion of the SOL. 14.01.2022 Planning and Development (Project Facilitation) Amendment Bill 2014: This amendment to the Planning and Development Act 2007 seeks to improve the process of development assessment and creates a function for Territory Plan variation in order to fast track developments within the ACT. The proposed amendment to the current laws will allow the Executive to waive legislative operation of the Heritage Act 2004 and the Tree Protection Act 2005. Included in this bill include the introduction of a time limit to bringing court proceedings and importantly powers to the Planning and Land Authority in amending and variation of Territory Plans.

10.01.2022 On 7 April 2014, Australian Prime Minister Tony Abbott and Japanese Prime Minister Shinzo Abe announced the new Japan-Australia Economic Partnership Agreement (JAEPA). The High Court of Australia overturned the decision of the Full Federal Court, and held that a coding for a BRCA1 protein was not a patentable invention under s18(1)(a) of the Patents Act 1990 (Cth).... The bottom line of property law regarding human body, including cells, is that an individual cannot claim property rights over his/her own body parts once it is removed from them. However, technology and medical research developments posed some challenges to the validity of this concept, in the age where extensive researches involving human body cell are carried out by giant pharmaceutical companies as well as medical institutions around the world. Whoever that’s manufactured the cell can claim patent over the cell, hence making it their intellectual property. It is the existence of the effort put into it by the researchers and scientists that distinguishes the patented cells from human body cells that exist in their natural state. BRCA1, the subject matter of D’Arcy v Myriad Genetics Inc case, is a gene found in all humans. It repairs damaged DNA, or destroys irreparable DNA, and therefore if BRCA1 itself is mutated, damaged DNA is not repaired properly and this increases the risk of breast cancer. Myriad Genetics Inc isolated the nucleic acid of the BRCA1 gene from human cells, and was granted a patent in Australia. Their technology involves screening for the mutations which could eventually become tumours. A breast cancer-survivor Yvonne D’Arcy, represented by Maurice Blackburn, brought a lawsuit against Myriad Genetics to invalidate their patent in Australia. In contrast to the preceding lower-court decisions, the High Court unanimously held that the invention claimed did not fall within the concept of a manner of manufacture under the law. Although human action was involved in isolating it, the essential element of the invention was the existence of the information stored in the relevant sequences. It is still too early to determine the impact of this decision. On the one hand, this can be viewed as a victory for public health system as this could mean universal access to some future cancer treatments to come. On the other hand, there are concerns that this could potentially hinder the progress of medical innovations as it might reduce incentives for researchers and especially pharmaceutical companies. There are more patented inventions derived from genetic materials other than the BRCA1. Whether they would also be subject to legal challenge, and if so how those would be decided is also something to keep an eye on.

04.01.2022 Australia and South Korea have as of the 8th of April formally signed a Free Trade Agreement during Prime Minister Abbotts visit to Seoul. Minister Robb and his Korean counterpart, Trade Minister Yoon, concluded negotiations on the Australia-Korea Free Trade Agreement (KAFTA) in early December 2013. The KAFTA agreement was then signed at a ceremony in Seoul with Prime Minister Abbott in attendance. The KAFTA agreement is set to boost economic ties with both countries by dec...reasing trade tariffs for various commodities. The KAFTA agreement also opens up Australian domestic markets to real estate for Investors, by the progressive reduction of market access barriers in key sectors including telecommunications, legal services and accounting and tax agency services. The Foreign Investment Review Board has also under the agreement increased its screening threshold from $248 million to $1,078 million, falling in line with other privileged partners that include New Zealand and the US. The agricultural sectors are to benefit most from the agreement with Korea eliminating its existing tariff on Australian Beef, Sugar, Diary, Horticultural and Seafood products. The movement of citizens of both partner countries are set to gain from the agreement with Intra-corporate transferees, independent executives, contractual suppliers and business visitors enjoying an extended Visa regime.
