16.01.2022 STATUS OF DEVELOPMENT PROPOSAL MCU013407 232-234 Birkdale Rd Birkdale 15/01/2016 Summary: On the 9th of December 2015, the Redland City Council granted its preliminary approval of a development application on Birkdale Rd/Dorsal Drive that attracted 219 community objections. The development was approved subject to modifications that should see a reduction of the development from 4 to 3 storeys, the number of Units reduced to 17 and some design changes. The proposal had already... been reduced from an original 26 units to 22 units by the removal of the 45m2 1 bedroom units by converting them into 2 bedroom units. The Developer has been advised of the decision and has until mid-February to modify their proposal or seek to have the decision overturned by the Courts. Given that the land is zoned Medium Density, this decision, while not as ideal as an outright rejection, should deliver a less obtrusive development. 14.01.2022 The final approval of the Dorsal Drive development was held up by Christmas, the election and red tape. We believe the final approval has been made and should be public within the next week or so. However in the interim I have produced a news item showing the final submission, plans and an overview at www.aquaticparadisecommunity.com.au SUMMARY OF CHANGES ACHIEVED BY THE COMMUNITY Removal of 9 small 45m2 one-bedroom apartments Reduction in the number of units from the origina...l 26 to 16 Reduction in the number of stories from 4 to 3 (on Birkdale Road) The retention of all vegetation in the adjoining creek corridor Redesign of rubbish removal turnaround Onsite car parking improved (still be an overflow of parking onto Dorsal Drive) Building design improvements The ideal situation would have been a development that better fits in with the character of the neighbourhood and the streetscape. However given zoning and development oriented Council this is probably the best outcome we can expact. A great deal of thanks must go to Cr Paul Bishop whose total commitment to the Community and hard work assisted in achieving this outcome. The Mayor, Karen Williams, must also be thanked for providing access to herself, Council and Officers during the approval process. 14.01.2022 The buildings on the property at 100 Dorsal Drive (232 Birkdale Road) were demolished yesterday.

14.01.2022 COUNCIL PLANNING DEPARTMENT RECOMMEND APPROVAL OF A 4 STOREY APARTMENT BLOCK IN DORSAL DRIVE: 5/12/2015 Redlands City Council have released a review report of the Birkdale Road/Dorsal Drive development application to build a 4 storey apartment complex next to established low density residential housing with access only from Dorsal Drive. Even though the Birkdale Road/Dorsal Drive development proposal does not comply with the zoning codes in relation to the number of storeys ...and dwelling density, Council planners state in their report "overall the proposal is considered to comply with the relevant codes". The apartment block is a 4 storey development where the zoning code states a maximum of 3 stories and the density per dwelling of the proposal is 145m2 where the code states a minimum of 200m2. This represents a massive 25% movement from the code on both counts and resulted in over 200 objections lodged by residents. The RCC internal planning Department review of the Birkdale Road/Dorsal Drive development proposal has been made available publicly just 4 days before the Council meeting when Councillors will individually vote on the proposal. This is totally unacceptable given that Councillors were briefed on the contents in a workshop on Thursday the 12th of November. A request to Mayor Williams for a copy of the report and if there was support from Councillors was met with the response that she was "not at liberty at this time to reveal what recommendations may have been discussed with officers at the workshop, nor can she advise whether councillors support the application". It is believed the Qld State Government refused approval to allow access to the development from Birkdale Road (State managed road). However Council appears to have no problem with shifting the potential traffic issues into the middle of the local community via the Council controlled Dorsal Drive. This road services the low density residential area made up of canal blocks and dry blocks as well the wider neighbourhood and acts as a local thoroughfare for school children and cyclists. Councillors are not bound by the Planning report and any recommendation, they are free to reject it. The proposal will now be voted upon by all Councillors individually at the full Council meeting at 9.30am on Wednesday the 9th of December 2015 in Council chambers Cnr Bloomfield and Middle Streets Cleveland. Any member of the public can attend and anyone wishing to also address Council prior to the decision can apply by 4.30pm two days prior to the meeting. 13.01.2022 Developer responds to Council by maintaining 4 storey plan ! The proposed developer of 100 dorsal Drive has responded to Council for final assessment. The developer has basically;... 1. Made some provision for a suspended slab to protect adjoining trees. 2. Reduced the number of units from 26 to 22 by turning 8 one bedroom 45 m2 apartments into 4 X 2 bedroom apartments while still maintaining 4 storeys on Birkdale Road (code states a 3 storey limit). 3. Amendments to the driveway gradient and refuse manoeuvring zone. 4. An additional visitor parking space. The response states "we have discussed this strategy with Council and they have confirmed they support our direction and the assessment of the existing application can continue" which is very disappointing. We are now awaiting advice from Council as to the official recommendation that will be made to Councillors at the 4th of November meeting as it is ultimately up to Councillors to approve or reject the proposal.. The proposal response continues to make a mockery of the Redland City Council Zoning codes for both the number of storeys and the square metre minimum density requirements. The code clearly states up to 3 storeys and a minimum density of 200 m2 per dwelling. The proposal has 4 storeys and a revised density of approx 145 m2 per dwelling. 13.01.2022 Redlands Council today have voted to provide preliminary approval of the Dorsal Drive development proposal subject to conditions around the number of stories, building design and density. Thanks to Cr Paul Bishop for his support.

06.01.2022 Improvements to the 100 Dorsal Dve development.

06.01.2022 URGENT UPDATE 14-11-2015 Erin Ferris, Evron McMahon and Stephen Sharry made a full presentation to the Mayor, Karen Williams and Councillors Paul Gleeson, Kim-Maree Hardman, Alan Beard and Paul Bishop in Council chambers. The presentation outlined the history of the proposal and the residents objections and utilising powerpoint took 45 minutes. The Mayor and attending Councillors were respectful and interested in our view and they were thanked for their courtesy. Many quest...ions were asked. Unfortunately we do not know what Council staff will present so we had nothing to counter. We will not know what their recommendation is or what it is based upon until the 7th of December, 2 days before the decision is made. All Councillors were sent a summary email with a copy of the presentation attached and a request for them to reject the development proposal. On Thursday the 12th of November council planning staff presented councillors with a recommendation on the Dorsal Drive development during a workshop. We do not have any documentation on the planning staff review and have requested a copy from the Mayor. The proposal now goes to Council on the 9th of December for all Councillors to vote in favour or against the development. I will update you further over the next few days.

02.01.2022 DEVELOPMENT SITE FOR SALE 232 Birkdale Road/100 Dorsal Drive 13/09/2016 The site, which was the subject of over 200 objections to a proposed development which resulted in the approval of 16 units, has been placed on the market through Ray White Commercial Bayside. The sale detail was not found on the agents nor listing websites as yet.
