23.01.2022 LANDMARK CLIMATE RULING: A proposal for a new Hunter Valley coal mine has just been knocked back by the NSW Land and Environment Court - with one of the key rea...sons being climate change. The Environmental Defenders Office has dubbed it a "once in a generation case" as it's the first time an Australian court has heard expert evidence about the urgent need to stay within a global carbon budget in the context of a proposed new coal mine. SMH has a good story up on it here: https://www.smh.com.au//we-won-landmark-climate-ruling-as-

21.01.2022 We're proud of Arma Legal's practitioner / director Hayley Haas, who was nominated as a finalist in this year’s Lawyers Weekly Partner of the Year Awards. She was one of four in the Native Title Partner of the Year category. Hayley was recognised for her successful Full Federal Court litigation, in which a precedent was set for the protection of native title parties’ procedural rights. Congrats Hayley on the wonderful achievement!

14.01.2022 It's being hailed as one of "the biggest test cases in Indigenous rights since Mabo". Native title holders from Timber Creek, 600 kilometres south-west of Darwin, were initially awarded $3.3 million in compensation for extinguishment of their native title rights in 2016. But the Federal Court's decision was appealed by the NT and federal governments ... and the Full Federal Court then reduced the compensation to $2.9 million. Last week, the High Court reviewed the Full Federal Court's decision, in a case that will set a precedent about how to calculate native title compensation. http://www.abc.net.au//timber-creek-native-title-/10198442

13.01.2022 Today Justice Reeves determined that the Nyamal people held native title over an area of approximately 28.480 square kilometres of country in the central Pilbara starting near Marble Bar and extending north near Port Hedland. A determination by consent was reached after the state of Western Australia and 33 other respondents agreed to support a determination recognising rights over some parts of the claim and the extinguishment of some rights over other areas. Arma Legal is delighted to have represented the Nyamal people in this process.

13.01.2022 Arma Legal has been following with interest the fallout from last year’s High Court Case involving Fortescue Metal’s Group Chairman Andrew Forrest. The High Court ruled in favour of an appeal by Mr Forrest's private company, challenging the validity of mining lease applications lodged over his property by Yarri Mining and Onslow Resources. The High Court found that the leases were invalid, as certain documents were not filed at the same time as the lease application. This has... thrown the validity of hundreds of other leases into question. The federal government is urging the WA State Government to change the Mining Act (1978), while the State wants to Commonwealth to amend the Native Title Act 1993 (Cth). Arma Legal supports the principle of free, prior and informed consent and commends the Commonwealth for refraining from legislating in circumstances where mining leases have been entered into in the absence of native title agreement. 12.01.2022 Congratulations to the Boorroola Moorrool Moorrool (BMM) claimants who had their native title determination yesterday! After first submitting the native title claim in December 2016 they were finally able to celebrate an on-country determination. With the part determination of BMM, we are now one step closer to having native title determinations across the Kimberley. Once again congratulations and amazing work to everyone involved!

11.01.2022 Great initiative last week in the Pilbara! Aboriginal families in Newman, WA, had free family law legal advice and were able to get a Family Court hearing without having to make an appointment, or fill out paperwork. Check out the link

08.01.2022 This is a powerful piece on the case for native title reform. Barrister Tony McAvoy, talks to the ABC's Larissa Behrendt, and argues that the native title process embeds racism. It's a great listen! http://www.abc.net.au//pr/speakingout/tony-mcavoy/10133796

04.01.2022 Last week, the High Court ordered the NT government to pay $2.53m in compensation to a group of native title holders, in a landmark ruling establishing a significant precedent for future compensation claims. It is the first time the High Court has considered the monetary value of native title and associated compensation for the removal of land rights. https://www.theguardian.com//northern-territory-ordered-to
