ACT nomination - Eligibility Criteria - for 491 and 190 pathways You must meet one of the following two criterion:... 1. Your nominated occupation is on the ACT Critical Skills List; OR 2. You are the primary holder of a subclass 457/482 visa sponsored by an ACT employer The 5 years ACT residence criteria has ceased. Please note applicants will also need to meet the 6 months residency and employment for 190 and three month residency and employment for 491 as previously. 22.01.2022 SETBACK TO THE GOVERNMENTS PROPOSED CHANGES TO AUSTRALIAN CITIZENSHIP REQUIREMENTS. BIG WIN FOR FAIRNESS SO FAR Let’s wait and watch what happens leading upto 18 October 2017!!!! If the Citizenship Bill is not passed by 18th October 2017 and is discharged from the order of business on that date, this would effectively mean that the original legislative citizenship requirements remain in place. Therefore the Governments proposed new citizenship requirements cannot be imp...lemented. The Government’s proposed changes to Australian citizenship requirements could face an embarrassing end in the Senate. A Greens motion to strike the government’s citizenship bill from the notice paper passed the Senate on Wednesday 13 September 2017. This is a little used parliamentary process, whereby the legislation would effectively be 'struck off' the list of legislation being considered by the Senate. The Greens originally wanted the bill removed for consideration from the Senate immediately, but an agreement was reached to an amendment from crossbench Senator Jacqui Lambie to give the government until October 18 to vote on the bill, If the Citizenship Bill cannot be passed by 18 October 2017 and is discharged from the order of business on that date, the Government would need to reintroduce the Bill. However some political commentators have questioned whether they will have the numbers to do so. The Labour senators have so far labelled the English language requirements as ‘unreasonable and snobbish’. The Government’s proposed amendment to citizenship requirements would introduce a minimum of four year wait before permanent residents could apply for citizenship, stricter English language requirements and an Australian Values Test.

21.01.2022 457 VISAS AXED AND NEW STSOL & MTSSL LISTS ANNOUNCED. SOME CONSEQUENCES OF THE RECENT CHANGES TO IMMIGRATION POLICY: 1. Occupations such as cook and restaurant manager are on the STSOL list. While you can still be sponsored for 2 years by a restaurant on the 457 visa and gain another 2 year extension, you can no longer apply for a permanent visa unless it is added to the MLTSSL list for you being in a designated regional area.... 2. Retail manager is still available in regional areas for the 187 visa at the moment. But from March 2018 this will not be the case, as this occupation is not on the MLTSSL list. 3. Most student graduates will not be eligible for temporary or permanent company sponsorship after March 2018 as you require at least 2 years FULL-TIME WORK EXPERIENCE first. 20.01.2022 BREAKING NEWS: Priority Migration Skilled Occupation List (PMSOL) consisting of 17 Occupations in the health care, construction and IT sectors announced. Acting Minister for Immigration Alan Tudge has announced a new Priority Migration Skilled Occupation List (PMSOL) of 17 occupations that will be able to enter Australia to assist in the country's COVID recovery. Visa holders, who have been sponsored by an Australia business in a PMSOL occupation can request an exemption from... Australia’s travel restrictions, but will be subject to a strict 14 days quarantine on arrival at their own expense. Labour market testing will still be required to be able to sponsor application in these occupations. In addition to the current requirements of two national advertisements, employers must also advertise their vacancy on the Government’s jobactive wesbite. Existing skilled migration occupation lists will remain active and visas will still be processed, but priority will be given to those in occupations on the PMSOL. 14.01.2022 BREAKING NEWS 10 YEAR PIC 4020 BAN REVERSED / DISALLOWED IN THE SENATE The change to the recent law which meant that anyone who provided false information or documents to the Department of Immigration, Skill Assessment bodies, Administrative Appeals Tribunal would be banned for 10 years rather than 3 years has been disallowed in the Senate. This means that the old rule is in effect again and people who have been affected by PIC 4020 more than three years ago can once again... apply for visas to Australia. It was a great relief to see that such draconian laws were not supported by some reasonable and conscientious political leaders. These laws basically gave far reaching subjective powers to the Department of Immigration and The Minister in cancelling their visas, putting them in detention for minor offences like speeding tickets without proper natural justice being accorded to them and putting in 10 year ban on applicants from reapplying for visas The government might try to reinstate the law so this may only be a temporary change. We will keep you informed as the situation develops.

04.01.2022 WORRIED ABOUT YOUR VISA OPTIONS BECAUSE YOUR CURRENT VISA HAS EXPIRED OR IS GOING TO EXPIRE AND YOU ARE UNABLE TO DEPART AUSTRALIA-Temporary Activity visa (subclass 408) - COVID-19 Pandemic event visa might be your option The COVID-19 Pandemic event visa is only available to people: 1. who are onshore; AND 2. have 28 days or less remaining on their current visa; OR... 3. where their last substantive visa has expired up to 28 days previously. The purpose of the new visa option is to provide a pathway for certain former and current holders of temporary visas to lawfully remain in Australia and to also address the workforce shortages in critical areas like agriculture, aged care and public health during the COVID-19 pandemic. COVID-19 Pandemic visa will allow the applicant to: 1. remain in Australia if they have no other visa options and are unable to depart Australia due to COVID-19 travel restrictions; 2. remain in Australia to assist in critical sectors including healthcare, disability and aged care, childcare and agriculture and food processing during the COVID-19 pandemic. The Department will consider each application on a case-by-case basis, taking into account the person’s country of origin and other circumstances. 04.01.2022 NSW 491 Nominations open from 15 June 2020 to 23 June 2020 NSW immigration will begin accepting for NSW nomination for the Skilled Work Regional (Provisional) visa (subclass 491) on Monday 15 June 2020 and will stop accepting applications at 5pm Tuesday 23 June 2020. Applications will be assessed by the end of the financial year; Tuesday 30 June 2020.... Who can apply? Only candidates who meet all the requirements below will be able to submit an application. The NSW nomination fee is not refundable. Requirements You can only apply for NSW nomination if you meet Department of Home Affairs’ requirements for the 491 visa and: have an occupation on the NSW Stream 1 Regional Skilled Occupation List, and; have been living in a designated regional area in NSW for at least the last 12 months, and; have been working in a designated regional area in NSW for at least the last 12 months, and; have been working in your nominated occupation, or a closely related occupation, for at least the last 12 months. If you do not meet all of these requirements, you are not able to apply for NSW nomination. How to apply NSW will advise on how to apply for NSW nomination on Monday, 15 June 2020. Your application As NSW have a short time-frame to assess your application, it is important that your application is complete.

03.01.2022 KEY HIGHLIGTS OF THE (DRAFT) ACT GOVERNMENT’s NOMINATION PROGRAM COMMENCING ON 29 NOVEMBER 2018. The new ACT nomination policy will basically comprise of 12 factors under which applicants can receive points on the internal ACT points system. The ACT government will then be selecting the candidates with the highest scores for the ACT state nomination. These factors are not related to the factors required to reach 65 points for the subclass 190 visa points test. KEY FEATURES OF... THE NEW ACT NOMINATION PROGRAM (Please note this is at the Draft stage and Final guidelines will be released shortly by the ACT Government) The ACT nomination program will open to overseas applicants as well on the 29th November 2018. You can lodge an expression of interest whether your occupation is on the OPEN List or not. You cannot apply for the ACT nomination if you or any of your immediate family member is living in another Australian state. From 1 July 2019, the minimum ACT residence criteria for student/temporary graduate visa holders will increase to 2 years. To meet the Canberra residence requirements, the intending applicant can live in Canberra (obviously!) or live within a 30-minute commute radius of Canberra (for example, live in Queanbeyan, Jerrabomberra, Bungendore, Murrumbateman) but they need to be working in Canberra At this stage it is being deemed that Intending applicants who live in Canberra but work outside of Canberra for example in Queanbeyan, for example, are ineligible to receive an invitation. If you are nominating an ANZSCO Major Occupation group1 (Managers) or Group 2 (Professionals) occupations, applicants must have Proficient English. The ACT Government reserves the right to limit the numbers of any particular occupation invited to apply. This discretion could be applied to Accountants, for example, to limit the number of Accountants who will be offered ACT nomination program. The applicants will be awarded additional points if their occupation is OPEN, and for their level of English, how long they have lived in Canberra, the length of their course, their employment, the assets they have invested in Canberra, their partner’s employment and qualifications, and whether they have family in Canberra. Additional points will be awarded to people who were living in Canberra on 29 June 2018, the date on which the previous program closed to those who did not have an occupation on the OPEN list. New occupations will be added to the OPEN List and several occupations will be removed. The ACT government will be releasing its new OPEN list shortly STAY TUNED FOR FURTHER UPDATES

02.01.2022 BREAKING NEWS!!!!: ACT NOMINATION SUSPENDED FOR CANBERRA RESIDENTS WITH CLOSED OCCUPATIONS. Effective immediately (4pm AEST, Friday, 29 June 2018): FOR CANBERRA RESIDENTS:: ... The ACT 190 nomination program is now suspended for Canberra residents with a nominated occupation listed as ‘closed ‘on the current ACT Occupation List. Canberra residents with a nominated occupation listed as ‘open’ on the current ACT Occupation List are still eligible to apply for ACT 190 nomination. FOR OVERSEAS RESIDENTS: The ACT 190 nomination program remains closed for overseas applicants without close ties to Canberra, and is now closed to overseas applicants with close ties to Canberra. WHAT HAPPENS TO CURRENT APPLICATIONS WHICH HAVE BEEN LODGED PRIOR TO 4PM AEST FRIDAY 29 JUNE 2018 WITH THE ACT GOVERNMENT?????: Applications already lodged prior to 4:00pm AEST Friday 29 June 2018 will not be affected by this suspension. Although these applications will be processed in 2018/19, they will be grandfathered and assessed against the existing 2017/18 nomination criteria. FURTHER UPDATES WILL BE PROVIDED AS THEY BECOME AVAILABLE.

01.01.2022 ADDITIONAL POINTS FOR SINGLE AND MARRIED PROFESSIONALS COMES IN FROM 16 NOVEMBER 2019. This new point system will provide many opportunities for both single and for those with partners with favourable assessed skills and English abilities to acquire more points for subclass 189.190 and 491 visa (skilled visas). What it potentially also means is that applicants with Partners with no skill assessment and/or good English language ability (competent English) are going to be di...sadvantaged and are going to get lower rankings Brief synopsis of this new point system are: Partner points (only 1 score allowed) 10 points if you are single. 10 points if you have a partner who is an Australian citizen or Permanent resident. 10 points if partner has an acceptable skills assessment and competent english. 05 points if your partner has competent english (IELTS 6,6,6,6 or equivalent). 00 points any other case. This will affect ALL of the points test categories for EOIs not yet invited (189,190,491). Ranking Order (if all other points claims are EQUAL) First primary applicants with a skilled spouse or de facto partner. Equal First primary applicants without a spouse or de facto partner. Second Primary applicants with a spouse or de facto partner who can demonstrate competent English but does not have the skills for skilled partner points. Third Primary applicants with a partner who is ineligible for either competent English or Skilled partner points. These applicants will be ranked below all other cohorts, if all other points claims are equal.
