25.01.2022 How Long Should I Sign Up For?? The usual ‘sign up’ period with an agent is 90 days. This is known as the exclusive agency period and is the period that the agent is given the sole right to market and sell the property. After this period, the sellers will leave the listing with agent if they are happy with the service, or they can elect to appoint another agent. What we have found is that some agents use agency agreements that require the sellers to give 30 days notice to ter...minate the agreement. As this is not usually disclosed at the time of signing up, sellers can unknowingly sign up for 120 days or more. It only becomes apparent when the sellers wish to change to another agent, only to find out that they are tied to the agent they’re not happy with for another month. At a minimum, home sellers should ensure that at the end of the 90 day exclusive agency period they can terminate the agreement immediately. The best position to be in is where the agent provides a guarantee that if at anytime during or after the exclusive period the sellers are not satisfied with the service and that dissatisfaction cannot be resolved, the sellers are free to terminate the agreement with immediate effect.
