The Fair Work Commission found that a major employer did not act harshly, unjustly or unreasonably when it dismissed a worker for being distracted by his mobile phone for 10 seconds while driving a road train carrying fuel to mine sites. The employer had specifically nominated the use of mobile phones as attracting the penalty of termination of employment under its driver behaviour policy. The driver unsuccessfully argued that he only looked at the phone for a short time to play music through the Bluetooth system in the truck, and was not using the phone to call or text. In upholding the company’s decision to terminate the driver’s employment, the Deputy President found that wilful violation of an important employment obligation and potentially a state road regulation provided a valid reason for his employer to dismiss him.
