08.01.2022 Having an ABN and issuing invoices doesn’t automatically make you your own boss - aka an independent contractor. Knowing the difference is important to avoid mi...sclassification or sham contracting. Sham contracting is when an employee’s deliberately been told they’re an independent contractor to avoid having to pay their legal minimum entitlements like wages, leave and hours of work. There’re some common indicators that can help you tell the difference between an independent contractor and an employee, like the amount of control you’ve got over how and when work’s completed. For example, a gardener who’s an employee, attends sites at the times directed by their boss, is told to mow the lawns in a particular way and uses their boss’s mower. While a gardener who’s an independent contractor, chooses their preferred suppliers and decides how and when to provide the landscaping services. Some common things to look out for include whether you: can subcontract and get another person to do the work bear the financial responsibility and risk for each job use your own tools and equipment choose your own hours of work are engaged in a specific task. You need to consider all of these indicators when figuring out whether you’re working for yourself or if you’re an employee. 07.01.2022 Superannuation payments June quarter - please ensure staff super is paid and received by super funds by 30 June 2021 if you wish to claim it as a tax deduction in the 2021 financial year. For Xero employers using auto super, SuperChoice has suggested you submit and approve Auto Super batches before 2pm AEST, 22 June 2021, which should allow for contributions to reach the super fund providers no later than 30 June 2021. Legacy employe...rs can still give you some JobKeeper directions, such as reducing your hours, as long as you were previously eligible for JobKeeper. To give these kinds of directions, they must follow other conditions too. If your boss is a legacy employer and has any existing JobKeeper directions with you, they will end on 27 September 2020. Any new JobKeeper direction made by your boss to reduce your hours of work must: leave part-time and full-time employees with at least 60% of your ordinary hours as at 1 March 2020 (although sometimes a different way of working out these hours can apply), and result in you working for 2 hours or more on a workday.
