01.01.2022 ------------------ Don’t take Partner visa for ‘granted’ ------------------ Amidst all the debate on the partner visa front in Australiadominated mostly over the high fees and longer processing timea ruling by the Federal Circuit Court in February has added another dimension to it. The court has upheld a ruling by Administrative Appeals Tribunal (AAT) that having lived in Australia for long, being in a genuine spousal relationship and having business interests are not neces...sarily the compelling reasons for a grant of waiver of the conditions given in Schedule 3 for a Partner visa. In this case the applicant arrived in Australia in June 2009 and in July 2012 she was granted a student visa which expired in April 2014. In September 2012 she married an Australian citizen but did not lodge her application for a Partner visa until May 2014, well past the 28 days required to do so. Also, no reasons were put forth for not filing the application during the time provided. This ruling adds another layer of complexity for the grant of Partner visa now as those who are already inside the country would be forced to part ways.
