19.01.2022 A subject to finance clause is a clause that’s intended to protect the purchaser. It states that you agree to purchase the property on the basis that your finance, is approved. This clause makes the purchase conditional upon receiving finance, generally in the form of a home loan. The clause gives you the option of terminating the contract and recouping your deposit if your finance is not approved and you notify the relevant people within the prescribed time frame. 17.01.2022 Did you know when you are buying a property, you cannot just rely on the vendor’s disclosure (Vendors Section 32 Statement). The vendor only has to disclose certain information set out under the Act. So, it is very important that a Purchaser completes due diligence before a Contract of Sale is signed, if there are issues it could be difficult for you to get out of a Contract. 16.01.2022 Section 27’ is actually called an Early Release of Deposit Statement. It is commonly referred to as a Section 27 as it is implemented under Section 27 of the Sale of Land Act. Generally, when purchasing real property, the purchaser will be required to pay a deposit of around 10% of the sale price. This deposit is usually held in a trust fund until Settlement, at which time it is transferred to the vendor. If the vendor wants the deposit money prior to Settlement, they may ask... for an Early Release of Deposit Statement. In order for the deposit to be released early, the requirements under the Act and both parties must sign the document. To determine whether or not an Early Release of Deposit is appropriate and what information is required, it is best to seek advice from your Conveyancer. 16.01.2022 New HomeBuyer Grant $25K HomeBuilders scheme grant It has been revealed the $25,000 HomeBuilder grant for new home builds and renovations will commence from midnight on 4 June 2020... To be eligible for the HomeBuilder scheme, you must: Be an Australian citizen aged 18 years or older and be an individual, not a company or trust. Be on an income of less than $200,000 for couples, and $125,000 for singles. Be spending between $150,000 and $750,000 on a renovation for a home that has been previously valued at less than $1.5 million. Be building a new home worth less than $750,000 (this includes land value). The grant will be offered for contracts entered into between 4 June 2020 and 31 December 2020. Construction must be contracted to begin within three months of the contract date to be eligible. The State Revenue Office will administer the HomeBuilder program in Victoria on behalf of the Australian Government. Information about how to apply for HomeBuilder will be published on the State Revenue Office website as soon as it is available. 14.01.2022 Following government announcements for stamp duty waiver, The State Revenue Office has now finally uploaded information regarding the stamp duty waiver being provided for Contracts entered into on or after 25 November 2020 until 1 July 2021. Is appears stamp duty waiver will automatically be taken into account at the time your Conveyancer claims the duty for settlement, as long as you have met the criteria. 05.01.2022 This is really good news. Sunset clauses A vendor will not be able to rescind a residential off-the-plan contract under a sunset clause without first obtaining written consent from affected purchasers or an order from the Supreme Court.... Any termination under a sunset clause after 23 August 2018 will require the vendor to obtain the purchaser’s written consent: giving at least 28 days’ notice; provide details of the reasons why: there has been a delay in registering the plan of subdivision or issuing an occupancy permit; and the vendor proposes to rescind the contract; and advise the purchaser that it is not obliged to consent. This legislation applies to "sunset dates" ie ‘sunset dates’ are defined by reference to a date by which the plan of subdivision must be registered or the occupancy permit issued (see Section 4 definitions of the new Act) and so don't appear to restrict terminations for others.
