21.01.2022 A new campaign has launched this week to strengthen Queensland's laws on racial and religious vilification. The campaign, #BetterLaws4SafeQld, is being run by ...the Cohesive Communities Coalition. We are proud to be a member of this coalition, but sad a campaign like this is necessary. Queensland is richly diverse, and the coalition represents over 20 ethnic and religious communities. They are calling for changes to the law which would address the gap in current protections, the under-utilisation of the existing offence, the display and distribution of hate symbols or hate material, and low rates of reporting and community confidence. The changes the coalition are seeking are outlined in a paper which can be downloaded from the campaign website at https://betterlawsforsafeqld.com.au/our-call-for-change/. 17.01.2022 It’s Human Rights Month and today’s right in focus is the right to recognition and equality before the law. This right is protected by section 15 of the Act and... means that: You have rights. You have the same rights as everyone else. A government service should not unreasonably prevent you from using that service, even if you: have different needs; can’t read or write; speak another language; have a disability; have another attribute that may stop you using the service in the same way as everyone else. If you are not treated fairly it could be discrimination. Discrimination is against the law. To a lot of people this seems like common sense, and also a double-up. Isn’t discrimination already unlawful under our Anti-Discrimination Act? Well, yes but only discrimination on the grounds of particular characteristics (like race, or sexuality, or age, for example), and only in particular places (like at work or when you’re buying goods or services). There are also exemptions to the law which can apply. The difference between that and the Human Rights Act is that the HRA applies to everyone in all their dealings with the public sector and the definition of discrimination under the Human Rights Act includes discrimination as it’s defined by the Anti-Discrimination Act, but it’s not confined to that. We’ll need some case law to help define exactly what this means in Queensland, but based on international law, it could include discrimination against people for a much wider range of characteristics than those protected by the Anti-Discrimination Act, including socio-economic disadvantage or living in a rural location.
