Now the question is, can you be separated while you are still living in the same house? The answer to this question is, yes, you can. You can be separated from your spouse even if you are living in the same house. There is no legal or official document to submit to say that you and your spouse are separated. However, the court takes several factors into its account to establish that you and your spouse are validly separated while you both were living under the same roof. For example: You don’t wear your wedding rings anymore Stopped engaging in any intimate or sexual activities. Closing joint bank account Both of you act in a way so that it is understandable to people around you that the relationship is over. The easiest way you can do this is to send a text or an email to each other confirming the date of separation. 3 If you have children from the marriage then it is your duty to make arrangements where they feel innocuous and are appropriately dealt with. You need to allow 42 days if your ex-partner lives overseas. You can personally serve this or organize someone to do it on your behalf, e.g. your lawyer. What’s next after you file? About eight weeks after your filing for divorce, you will receive a hearing date. The court will grant a ‘decree nisi’ meaning that it will bring an end to the marriage on a proposed date which is 1 month and 1 day after the decree nisi was granted.
