07.01.2022 Temporary Graduate Visa (Subclass 485) Australian Federal Police Check One of the criteria for the grant of Temporary Graduate Visa (Subclass 485) is that the applicant should have applied for Australian Federal Police Check in the 12 months PRIOR to the visa application. In the following case:... http://www.austlii.edu.au//viewdoc/au/cases/cth/AATA/2018/ Applicant applied for subclass 485 visa on 6th March 2017. However, the applicant applied for Australian Federal police check on 7th March 2017 (just one day after the application was submitted). Just because of this 1 day difference between the AFP application and the visa application, the Tribunal was unable to grant the visa to the applicant in spite of the fact that the applicant met all other requirements of subclass 485 visa This is just one example of many stringent criteria applicable to subclass 485 visa application. For further information, please contact Rajan Goel on 0411 705 499.

06.01.2022 Visa holders with an 8503 condition (no further stay condition) on their visa cannot validly apply for another visa while inside Australia (other than a protection visa or, in certain circumstances, a BV). However, a visa applicant can request a waiver of this condition if compelling and compassionate circumstances exist. This condition could automatically be waived if the visa applicant is applying for a certain kind of visa such as General skilled Migration Visa, even in th...e absence of compelling and compassionate circumstances. 03.01.2022 FACT: If your boss is underpaying you and threatening to cancel your student visa because youve worked more than you should have, we can help you. Remember, o...nly the Department of Home Affairs can cancel visas. We have an arrangement with Home Affairs to encourage workers who are being exploited to get our help even if theyve breached their student visa conditions. Under this arrangement, your temporary visa will not be cancelled if you: had an entitlement to work as part of your visa believe you have been exploited at work have reported your circumstances to us are actively assisting us in an investigation. This applies as long as you commit to abiding by your visa conditions in the future and where there is no other basis for visa cancellation (such as national security, character, health or fraud grounds).
