23.01.2022 ***** Australian Migration Program 2020-21 Updates ***** Department of Home Affairs, Australia has recently addressed the impact of COVID-19 on migration program for the year 2020-21. Border closures have resulted in a decline in net overseas migration. This is expected to fall even further in the year 2020-21. Unless otherwise advised, the existing 2019-20 migration places will continue to remain in place for 2020-21 at 160,000 places. This includes:... - 108,682 places for the Skill Stream - 47,732 places for the Family Stream - 236 places for the Special Eligibility Stream - 3,350 places for Child Visas State Nomination programs for Migration Year 2020-21 Places for the following categories will be made available to the state and territory nomination authorities for 2020-21 migration year: - Skilled Nominated (subclass 190). - Skilled Employer Sponsored Regional (Provisional) (subclass 491). - Business Innovation and Investment Program. Invitation Rounds for SC189 and SC491 visa Government is closely monitoring migration program to ensure that it does not displace the job opportunities for Australians so Australians can deal with post recovery measures of COVID 19. Targeted invitation rounds have continued each month to address critical sectors and aid Australia's recovery post COVID 19. Migrants entry to Australia - Only Australian citizens, permanent residents, immediate family members of an Australian citizen or permanent resident or New Zealand citizens usually resident in Australia can travel to Australia. - Immediate family members of Australian citizens and permanent residents who hold a temporary visa will need to provide evidence of their relationship. - Immediate family members of an Australian citizen/permanent resident include his/her spouse and children. - All travellers arriving in Australia by air or sea must isolate themselves in mandatory quarantine accommodation for 14 days from their arrival. 21.01.2022 **** TASMANIA STATE NOMINATION UPDATE **** Updated Processing time and News Fees Schedule The current processing time for the majority of Tasmanian state nomination applications is between 4 and 5 months.... All Tasmanian state nomination applications (Subclass 190 and Subclass 491) will incur a fee for services of $220 (GST inclusive). This fee has to be paid at the time of lodgement of the application. COVID-19 Waivers for Students Students currently in Tasmania: Online study with a Tasmanian education provider during the period courses were not able to be delivered on campus is also acceptable now. Student must have been living in Tasmania while completing the study online. Currently overseas - partially completed courses: Online study for applicants who started their courses in Tasmania, departed temporarily and have been unable to return to Tasmania due to COVID-19 restrictions will be accepted. Applicants must have started course in Tasmania, lived for a minimum period of 12 months and completed a study of minimum 12 months on campus. New enrolments course commenced outside Tasmania: Applicant who commenced study with a Tasmanian education provider but could not arrive in Australia due to COVID-19 travel restrictions will be considered if they complete a two year course and arrive in Tasmania soon after restrictions have been lifted and live and study in Tasmania for a period of at least 12 months. Courses of one academic year: These must be completed solely in Tasmania and no period of online/remote study will be accepted. This includes students who enrolled in one-year courses but could not arrive in Tasmania due to travel restrictions. 21.01.2022 ***** FEDERAL BUDGET 2020 and VISA CHANGES ****** The Australian government released some details into its immigration planning for 2020-201 with family visas, employer-sponsored visas, and business and investment visas the clear winners in terms of priorities among the 160,000 places, however, the addition of English requirements for partner visa applicants and sponsors, and increased sponsorship requirements and obligations to partner visas threatens to dramatically change ...the partner visa program. Highlights from the budget papers regarding immigration: Partner Visa Changes The Government will apply the family sponsorship framework to Partner visas which will mandate character checks and the sharing of personal information as part of a mandatory sponsorship application and subject the sponsor to enforceable sponsorship obligations. These changes will complement existing family violence provisions within the Partner visa program. The Government will introduce English language requirements for Partner visa applicants and their permanent resident sponsors. These changes will help support English language acquisition and enhance social cohesion and economic participation outcomes. Overall Migration Program Planning Levels The Government will maintain the 2020-21 Migration Program planning level at 160,000. Family Stream places will increase from 47,732 to 77,300 places on a one-off basis for the 2020-21 Migration Program year, and Employer Sponsored, Global Talent, Business Innovation and Investment Program visas will be prioritised within the Skilled Stream. Onshore visa applicants and Partner visa applicants where the relevant sponsor resides in a designated regional area will also be prioritised for the 2020-21 Migration Program. COVID-19 Related Visa Application Refunds Prospective Marriage, Pacific Labour Scheme and Seasonal Worker Programme visa holders will be able to access a VAC refund. Temporary skilled workers and visitor visa holders will be eligible to have the VAC for a subsequent visa application waived, to allow them to return to Australia once travel restrictions are lifted. Working holidaymakers will be eligible to have the VAC for a subsequent visa application waived, to allow them to return to Australia once travel restrictions are lifted or otherwise be able to access a VAC refund. Business and Investment Visa Changes From 1 July 2021, the Government will streamline and improve the operation of the Business Innovation and Investment Program (BIIP). The Government will introduce changes to improve the quality of investments and applicants. Visa application charges for BIIP visas will also be increased by an additional 11.3 percent (above regular CPI indexation) on 1 July 2021. 14.01.2022 ** Australia's borders to remain closed for a long time ** Australia's health minister Greg Hunt stated that Australia is an "island santuary" and the borders will remain closed for quite some time. This is due to the COVID-19 infections on the rise around the world. The health minister appeared to suggest that international borders would remain shut until a vaccine for COVID-19 has been found. Victoria's active cases have more than doubled in a week taking the total to 125. The active cases in New South Wales state have increased by 22 in the past week.

Temporary Graduate Visa SC485 1. International students who are offshore and have completed their Australian studies online will be able to apply for SC485 visa from outside Australia. 2. The SC485 visa will also be granted to international students while they are outside Australia even if they are not able to make an entry into Australia due to COVID-19 and border restrictions. 3. The period to meet the Australian study requirement (i.e the period between completing study and applying for the SC485 visa) will be extended from six months to 12 months for applicants prevented from returning to Australia due to COVID-19 travel restrictions. Skilled Regional Visa SC887 1. Concessional Period: The department has provided a concession of 3 months in Employment period and 6 months in residence period for lodging an application for SC887 visa. This means that Skilled Regional (Provisonal) SC489 visa holders can apply for Permanent Residency visa SC887 once they have worked for 9 months instead of 12 months and have resided in Australia for 18 months instead of the usual 24 months. 2. Location at time of Application: The SC887 application can be lodged even from outside Australia if the applicant(s) have satisfied the above period for employment and residence. 3. Location at time of Grant: The SC887 visa would be granted to the applicants even if they are outside Australia. They are no longer required to be in Australia at the time of grant.
