25.01.2022 AUSTRALIA NEW LAW EFFECTIVE 24TH NOVEMBER 2020 UNDER WHICH 482/457 VISA HOLDERS CAN APPLY FOR PERMANENT RESIDENCY IF FILED APPLICATION AFTER 1ST FEB 2020 EVEN IF THEY HAVE WORKED FOR LESS HOURS DUE TO COVID-19 FOR WHICH MIGRATION(TRANSITIONAL OPERATION )AMENDMENT INSTRUMENT PASSED ON 13TH NOVEMBER 2020 WHEN DOES IT COMMENCE? The new law came into effect on Tuesday, 24 November 2020 but applies to all applications made on or after 1 February 2020. This is to ensure that... all impacted visa holders continue to be eligible to apply for permanent residence, even if they have made their application for nomination prior to the commencement of this new law. These arrangements are in place to ensure that temporary visa holders, subclasses 457/482, who experienced certain temporary changes to their employment arrangements due to Covid-19 are not disadvantaged in relation to the requirement under the old law to have been employed in the position in relation to which they hold the subclass 457/482 visa for the relevant period of time (a total period of at least three years, or two years if March 2018 transitional arrangements apply), not including unpaid leave. The effect of this new law is that the period of time required to be employed in the occupation and the position when visa applicants apply for their permanent employer sponsored visas, subclasses 186/187 nominations and visas under the Temporary Residence Transition (TRT) stream, will not be affected by the visa holders working reduced hours or being on unpaid leave during the concession period, as a result of the Covid-19 pandemic. This is a welcoming and much needed change for many temporary visa holders affected by the Covid-19. The concession period is defined as commencing on 1 February 2020 and ends on a day specified by the Minister. https://www.legislation.gov.au/Details/F2020L01446

20.01.2022 AUSTRALIA 2685 INVITATION ISSUED FOR RESIDENCY UNDER FASTEST DISTINGUISHED TALENT SUBCLASS VISA(124 AND 858) BETWEEN 1ST JANUARY TO 9TH SEPTEMBER 2020 AND MAXIMUM GRABBED BY MIGRANTS FROM IRAN FOLLOWED BY BANGLADESH INDIA CHINA UK AND MOST WERE ALREADY IN THE COUNTRY WITH YEARLY QUOTA THIS YEAR STANDS INCREASED FOR GLOBAL TALENT INDEPENDENT PROGRAM FROM 5000 TO 15,000 REQUIRING MINIMUM ANNUAL SALARY OF $ 153,600 PLUS NOMINATION BY REPUTED SPONSOR A total of 265 h...ighly-skilled Indian nationals were invited to apply for permanent residency under the Global Talent Independent Program (GTI) between 1 January and 9 September this year. Indians emerged as the third highest recipients of the 2,685 invitations issued for applicants for a Distinguished Talent visa under GTI program, just behind Iranian and Bangladeshi nationals who received 539 and 384 invites respectively. Distinguished Talent visa is part of the Global Talent Independent Program, a high priority permanent residency pathway aimed at attracting the world’s brightest migrants at the top of their fields to Australia. Former senior Immigration Department official Abul Rizvi said it would not be wrong to assume that a large portion of successful applicants under the program were onshore and most likely are international students currently pursuing post-graduate research degrees in Australia. Around 70% of Iranian students are currently doing a post-graduate research degree. By comparison, around 1.5% of Indian students are doing a post-graduate research degree. There may be some universities/hospitals that are proposing these research post-grads as a means of retaining them as they complete their courses, he explained. The GTI program was launched in November 2019 with an aim to attract talented and highly skilled technologists working in one of the seven designated ‘future-focused’ sectors: ag-tech, med-tech, space, fin-tech, energy and mining technology, cybersecurity, and data science to live and work in Australia permanently. To be eligible, the applicants must demonstrate the potential to earn a salary at or above the income threshold of $153,600 each year and have their application supported by a nominator of national reputation in the same field. If the EOI is successful, the applicant receives a unique identifier and will be able to lodge an application online under the Distinguished Talent visa (Subclass 124) for those outside Australia and Distinguished Talent visa (Subclass 858) for those inside the country at the time of lodgement.

19.01.2022 AUSTRALIA GOOD NEWS AS 92 MORE OCCUPATIONS ADDED TO TWO DESIGNATED AREA MIGRATION AGREEMENTS OF SOUTH AUSTRALIA ON 29TH OCTOBER 2020 ENABLING MIGRANTS TO GET PERMANENT RESIDENCY WITH ADDITIONAL ENGLISH LANGUAGE AND AGE CONCESSION PLUS RELAX EXPERIENCE REQUIREMENTS FOCUSING ON HEALTH CARE MANUFACTURING HIGH TECH SECTORS AGRIBUSINESS FOOD PRODUCTION Skilled & Business Migration would like to advise that following the first annual review, the Australian Government has agr...eed to significant changes to South Australia’s two Designated Area Migration Agreements (DAMAs). DAMA Occupation List South Australia has secured a range of new occupations under the DAMAs with a focus on health care, manufacturing, high-tech sectors, agribusiness and food production. View the full DAMA Occupation List here. Concessions and PR Pathways South Australia has secured additional English language and age concessions, which will now carry over to the permanent visa. The changes to work experience requirements for a number of occupations will make it easier for qualified international graduates to be eligible to apply. All DAMA occupations listed will now offer a permanent residency pathway either through the Temporary Skill Shortage visa or the Skilled Employer Sponsored Regional visa. Skills Assessing Authority The South Australian Government has been approved to act as a skills assessing authority for occupations that require a skills assessment that currently has no alternative skills assessment authority. This will allow previously ineligible occupations to now be available for skilled migration, ensuring workers filling those positions are appropriately skilled. Skilled & Business Migration remains committed to working with South Australian employers to ensure they are able to fill skills shortages in their businesses. 17.01.2022 AUSTRALIA CORRUPTION IN VISA DEPARTMENT AS 167 COMPLAINTS RECEIVED FOR POTENTIAL CORRUPTION AGAINST OFFICIALS WORKING IN DEPARTMENT OF HOME AFFAIRS FEDERAL POLICE AND BORDER FORCE(WHICH MANAGE VISA AND BORDERS) DURING 2019-2020 AS PER REPORT RELEASED BY AUSTRALIAN COMMISSION FOR LAW ENFORCEMENT INTEGRITY The law enforcement watchdoghas seen a substantial increase in corruption notifications related to the Department of Home Affairs over the past year but said it refl...ected "growing maturity" rather than rampant misconduct. The Australian Commission for Law Enforcement Integrity (ACLEI) said it had received 172 notifications of potential corruption with 167 of those relating to bodies under the Department of Home Affairs umbrella, its 2019-20 annual report revealed. Of the 167 notices, 100 of those fell under "Home Affairs", which includes the Australian Border Force (ABF), with a further 63 relating to the Australian Federal Police (AFP) and the remaining four for the Australian Criminal Intelligence Commission (ACIC). A corruption notification is issued to the ACLEI by an agency head regarding potential corruption within their workforce. The watchdog then assesses the case and decides whether it warrants an investigation. The ACLEI cautioned the increase in notifications didn't necessarily indicate a rise in actual corruption, attributing it instead to the department's "growing maturity". "Overall, we consider that the increase in notifications represents the growing maturity of the department's integrity arrangements," the report read. "There does not appear to be any substantive change in the areas of Home Affairs in which corruption issues arise. Nor are we investigating an increased number of corruption issues notified by Home Affairs." The watchdog said it had launched 11 investigations from the full 172 notifications during the year with six of those falling specifically under the "Home Affairs" bracket. That number was far higher when it came to the total amount of active investigations. While it launched 34 new investigations over the year, it added to the 168 active cases, with Home Affairs being the focus of 105 of them. The report noted there were two key trends influencing corruption in law enforcement agencies - loyalty to workplace "in-groups" and exploitation of processes for personal benefit because "everyone does it". https://www.canberratimes.com.au//home-affairs-corruption/
