25.01.2022 "This decision demonstrates that the Courts will not readily accept that individuals are not personally liable for contraventions of the Fair Work Act if they are responsible for, or should have known, about minimum wages and entitlements. The Federal Court of Australia has made it clear, by referring to moral choices, that their expectation is that HR, Payroll and managers will simply do the right thing no matter what the personal cost."

12.01.2022 "Settlement agreements are usually negotiated between parties and involve one party paying a sum of money to the other party in return for discontinuing or no longer pressing the claim. It is due to this exchange of money that settlement amounts are misrepresented and perceived by many to be a bribe or hush money. But are settlement agreements really dirty Deeds or are they outcomes that benefit both parties commercially, emotionally and professionally?" Read more; http://bit.ly/2JcN1KU

08.01.2022 n this episode of 'Talking Payroll' Tracy speaks with Lynda McAlary-Smith, Executive Director - Compliance and Enforcement at The Fair Work Ombudsman. This is a wide ranging conversation where we talk awards, common mistakes seen by FWO, accessorial liability, litigation, record keeping, unions and more. 06.01.2022 Today Lush Cosmetics has admitted it has underpaid staff by $2 million which could affect 5,000 employees. Lush has apologised for the errors which they say have been because of the "intricate elements of the Retail and Manufacturing awards, which our very manual payroll system was just not sophisticated enough to interpret correctly." This included paying incorrect rates and underpaying staff when they did not have two consecutive days off, didn't have a minimum of 12 hours ...break between shifts, worked more than 11 hours in one day, and when part-timers worked outside their contracted hours of work. Tracy Angwin, CEO of Australian Payroll Association is not surprised to see another major company underpaying its staff because the payroll personnel in companies are not qualified with payroll qualifications, under supervised and have little or no knowledge of payroll legislation and no external support to keep them up to date. "Things have to change" said Ms Angwin. "This is not fair on Australian employees and employers need to take responsibility for their payroll departments, which they are not doing". "This includes ensuring they employ qualified payroll staff, provide them access to regular payroll training to keep them updated on all payroll related changes and regularly reviewing their payroll processes and technology to ensure they are delivering a compliant payroll function."
