25.01.2022 WHO ARE AFFECTED BY CHANGES IN AUSTRALIAN CITIZENSHIP REQUIREMENTS? New Australian Citizenship requirements came into effect on 20th April 2017. Citizenship applicants are required to show they have been in Australia for the last four years on any temporary or permanent visa, with a maximum of 12 months oversea. If applicants are on permanent visa, they are required to be present in Australia for at least 12 months, with a maximum 3 months oversea.... Commonly, ahead of applying for permanent residence, people will spend an amount of time on temporary visas, which include: 1. International students who are completing studies in Australia and applying for General Skilled Migration; 2. 457 visa holders who are applying for permanent residence through the Employer Nomination Scheme (ENS) 3. Partner visa applicants who first obtain a temporary partner visa, then qualify for a permanent partner visa 2 years after lodging their initial partner visa application. For now, the legislation to bring the changes into effect has not been passed by the Parliament until the end of 2017. Until then, applicants still have the option to apply for citizenship as long as they meet the requirements for Australian citizenship. The Regional Sponsored Migration Scheme (RSMS) visa (subclass 187) is a Permanent Resident Visa for skilled workers who have been nominated by an approved Australian employer and want to work in regional Australia. This visa involves a three-step process, firstly, approval from Regional Certifying Body (RCB), secondly, nomination by an approved Australian employer and then finally visa application under the nominated stream. If the visa application is lodged after receiving an approved nomination, it should be done within six months of the nomination being approved. What this visa lets you do? This is a permanent residence visa. It lets the visa holder and any family members who have also been granted this visa to: stay in Australia indefinitely work and study in Australia enrol in Medicare, Australia's scheme for health-related care and expenses apply for Australian citizenship (if eligible) sponsor eligible relatives for permanent residence travel to and from Australia for five years from the date the visa is granted Who is eligible for this visa? has been nominated by an approved Australian employer in regional Australia (outside of the Gold Coast, Brisbane, Newcastle, Sydney, Wollongong and Melbourne). If the nomination has been approved, the visa application should be lodged within six months for the date of nomination approval. is under the age of 50 at time of application lodgement, unless exempted has the required skills and qualifications for the nominated position at time of application lodgement the applicant must hold any mandatory registration, license or professional membership, or must already been fully assessed as suitable by the relevant body. has appropriate English language skills at time of application lodgement for Temporary Residence Transition (TRT) stream or Direct Entry (DE) stream, as applicable, unless exempted meets the health and character requirements meets the requirements of the stream in which the application has been made. The visa has three streams: Temporary residence transition stream The visa applicant might be able to get this visa under the Temporary Residence Transition stream if s/he meets the following criteria at the time of visa lodgement and provides documented evidence of the same. Skill assessment is not required as the employee has already worked for the nominating employer for two years in Australia. Direct entry stream The visa applicant might be able to get this visa under the Direct Entry stream if one of the following applies to the applicant: has never, or only briefly, worked in Australia holds a Temporary Work (Skilled) visa (subclass 457) but does not qualify for the Temporary Residence Transition stream is applying directly from outside Australia. Agreement stream The applicant might be able to get this visa under the Agreement stream if s/he is being sponsored by an employer through a tailored and negotiated labour agreement. What are the obligations as a visa holder? The visa holder has to begin employment with the nominating employer within six months of: first entry to Australia if s/he was granted this visa while residing outside of Australia; or the visa being granted if s/he was granted this visa while residing in Australia. The visa holder also needs to live in the regional area and remain in the position for the full two years. DIBP may cancel this visa if the visa holder fails to do so. The International English Language Testing System (IELTS) and The Pearson Test of English PTE are the most popular tests. Before deciding which one is right and appropriate for you, let's find out how different they are from each other. Apart from different historical backgrounds, in which IELTS started coming around in 1989 and PTE was... launched in 2009, these two also have different structures and test contents. An IELTS comprises four part: Reading, Listening, Speaking and Writing, and is completely paper-based. Continue studying will help international students lengthen their stay in Australia. For undergraduate students, they can choose to pursue either graduate diploma or master degree to gain higher level of qualifications and skills needed to get a job 2. Apply for a temporary visa Temporary Graduate visa allows international students who have completed at least 2 years studying in Australia. This visa has two streams: - Graduate Work stream A visa in this stream is granted for 18 months if the students have the skills and qualification related to a job on the Medium and Long-term Strategic Skills List (MLTSSL). - Post Study Work Stream, which allows the students to stay in Australia for from 2 to 4 years, depending on the qualifications, regardless of their field of study. 3. Gain professional work experience: Engineering, accounting and computer science graduates have the option to undertake a Professional Year Program, which is design to help them gain industry-specific skills through formal learning and workplace experience. Those who take on this program is also granted 5 points to qualify for a Skilled Migrant visa. 6. Apply for Permanent Residence via Skilled Migration if the student has an occupation on the MLTSSL. This visa involves a three-step process, firstly, approval from Regional Certifying Body (RCB), secondly, nomination by an approved Australian employer and then finally visa application under the nominated stream. If ...the visa application is lodged after receiving an approved nomination, it should be done within six months of the nomination being approved. What this visa lets you do? This is a permanent residence visa. It lets the visa holder and any family members who have also been granted this visa to: stay in Australia indefinitely work and study in Australia enrol in Medicare, Australia's scheme for health-related care and expenses apply for Australian citizenship (if eligible) sponsor eligible relatives for permanent residence travel to and from Australia for five years from the date the visa is granted What are the obligations as a visa holder?
