07.01.2022 FAQ: I would like to get a divorce immediately. Is this possible? Advice from Accredited Family Law Specialist, Melissa Muir: To apply for a divorce in Australia you must be separated for at least 12 months. This doesnt stop you from resolving property and childrens matters within that time.

03.01.2022 FAQ: Are property and childrens matters separate to a divorce? Advice from Accredited Family Law Specialist, Melissa Muir: Yes, the divorce is an administrative process that officially terminates the marriage. The divorce does not determine where the children are to live or how the assets and liabilities of the marriage are to be distributed.

01.01.2022 The Andrews Government has made a submission to the Fair Work Commission supporting family and domestic violence leave to be included in all modern awards. These recommendations, if implemented, would greatly assist women and victims of domestic violence to be able to leave abusive relationships, with up to 20 days paid leave per year. It would also minimise the reluctance some women feel to make an application to the Court for an Intervention Order, knowing they now have the financial security to take the required days off work to make the application.

01.01.2022 After the Family Court of Western Australia ruled in March that a six-year-old Perth boy with brain cancer is to undergo chemotherapy, his parents have now won a battle to stop him having radiotherapy, provided he continue chemotherapy. The Judge said that the childs parents had done what they thought was right, but was concerned that if the child were to have forced radiotherapy, he would be exposed to his parents hostility and bitterness, potentially causing him even more psychological trauma.
