22.01.2022 PARTNER VISAS - "LIVING TOGETHER" EVIDENCE Lots of partner visa applicants (including married couples) often struggle when it comes to providing evidence of l...iving together. It’s really important to understand what the Department of Home Affairs case officers are is looking for when it comes to living together evidence. If you are in a defacto relationship, in most instances the Department’s case officer will want you to provide solid living together evidence that dates back at least 12 months before the date upon which you submit your 820/801 or 4309/100 visa application. If your evidence doesn’t go back a full 12 months, your partner visa application may well be refused. Evidence comes into three main categories: 1. Excellent Evidence a. Lease agreements with both of your names on (in Australia or overseas) b. Property ownership (in Australia or overseas) c. Joint bank statements (in Australia or overseas) d. Medical bills showing your name or your partner’s name, address and date e. Utility bills showing your joint names/individual names, address and date f. Uber and Uber Eats accounts showing delivery address and date g. Traffic/speeding fines :-( showing name, address and date!!! h. Online orders -showing name, deliver address and date i. Joint travel/flight bookings and payment evidence j. Drivers licences (showing name and address) k. Gym memberships showing name(s), address and date l. College/university/course enrolments showing name(s), address and date m. Joint Christmas cards/invitations where you DO HAVE the original delivery envelope showing a postage mark/date n. Tax returns etc the list is endless and evidence from overseas is just as useful as evidence from Australia. 2. Good Evidence a. Form 888s made by Australians/PRs accompanied by ID evidence (At least 2 Form 888s are required in support of a partner visa application) b. Form 888s made by non-Australians/non-PRs in Australia - accompanied by ID evidence c. Form 888s made overseas and witnessed by an authorised person d. Date-stamped photos of you both with family and friends e. Photos of you both that relate to international travel/holidays f. FB and other social media posts/messages that make it clear that you are in a relationship and living together and show a date 3. Average Evidence a. Statements/letter from family and friends not on a Form 888 /Stat Dec/Affidavit b. Photos of you as a couple that don’t really contribute to the history of your relationship and aren’t date stamped. c. Joint Christmas cards/invitations where you don’t have the original delivery envelope showing a postage mark/date Evidence of "living together" is only one part of the partner visa application story, but it can be a very important part! 09.01.2022 NEW BORDER FORCE PORTAL FOR PEOPLE WHO NEED TO TRAVEL IN OR OUT OF AUSTRALIA This new portal is for people who are subject to the current COVID-19 travel restrictions and wish to travel because they: 1. are an immediate family member of an Australian citizen or permanent resident (being spouses, de facto partners, dependent children and legal guardians)... 2. are a New Zealand citizen who is usually resident in Australia 3. have a compelling or compassionate reason to travel to Australia urgently, including critical skills and medical emergencies 4. believe they meet a departure travel restriction exemption. The Department says that all requests should be submitted at least 4 weeks, but not more than 3 months, prior to travel.
