20.01.2022 There will be more employer sponsored Business Innovation and Investor Program and Global Talent visa places in Australia in the coming year as indicated by the 2021-22 Australian Federal Budget. About 50% of Department of Immigration funding will be devoted to skilled visa places with the subclass 188, subclass 124 and subclass 858 visas being the main focus of budget spending. The migration program will maintain 2020-21 levels of 160,000 visa places in total for the next fi...nancial year with a continued focus on onshore family visa applications being approved as well as the shift in focus for skilled visas. Net overseas migration is expected to fall from 154,000 in 2019-20 to around -72,000 persons by the end of 2020-21 before gradually increasing to 201,000 persons in 2023-24. The Global Talent visa Program will receive over $550 million in funding with the ATO providing fast-track tax advice to foreign investors and individual tax residency rules will be simplified. The number of Family visas will be capped at 77,300 places for 2021-22. As was previously announced the Adult Migrant English Program which helps new migrants to acquire english language skills will be given a shake-up. The 510 hour cap on education under the program will be scrapped in favour of allowing migrants to study until they have reached a ‘vocational’ level of english. 18.01.2022 PTE scores will remain the same for all visas being applied for now and any changes made to the PTE score requirements for entrance into educational institutions will be widely reported and will not apply retroactively according to the 2020 PTE and IELTS Concordance Report. The report has caused some confusion as it has recommended some scores be changed based on its research. The research involved collecting score data from candidates who each undertook PTE Academic and IELT...S Academic tests within a short time period. At IELTS 7.5 and above PTE scores will equivocate higher based on the report and at 6.5 scores will be lower. But don’t panic! The recommendations of the report will not kick in immediately and if you have lodged a visa application before the report’s recommendations are implemented your visa will still be assessed with the scale as it was at the time of application. 13.01.2022 New Concessions for Regional Work and Temporary Graduate Visas, Family Visas Re-Commencing Partner and child visas will start being granted on the 27th of February, 2021 while parent visas will begin to be granted on the 24th of March while temporary graduate visas will no longer be required to be onshore to lodge their visas. The raft of expected changes will also see safe haven enterprise visa applicants able to apply despite receiving benefit payments and periods of unem...ployment as well as business innovation residency requirements being retracted. Skilled regional visa applicants now only have to do 9 months full time work and 18 months residence in a regional area if offshore at the time of application. Applicants from inside Australia need to do the usual 2 years residence and 9 months full time work. Changes are active for visas applied for since the start of the concession period which began on the 1st of February, 2020. Business innovation visa applicants will be able to count time spent overseas towards the 1 year residency requirement in the 2 years before they applied for the visa if they held a business innovation visa. The first business innovation visa in the business innovation stream must have been granted on or before 30th June, 2019. Subclass 485 visas, the Graduate Work, the Post Study Work and the Second Post Study Work streams will all be granted concessions and may now be applied for from overseas. These expected changes mark a big shift in Australia’s immigration activities and are the start of the government’s response to the migration crisis facing Australia in a post-pandemic world. The subclass 858 visa is for those who have an internationally recognised record of exceptional and outstanding achievement in a profession, a sport, the arts or academia and research. 02.01.2022 Many businesses are suffering from a skills shortage but there is a type of visa which, even during the pandemic, allows employers to hire workers from overseas. The Temporary Skills Shortage Visa (subclass 482) is designed to fill positions in Australia that have not been filled by locals in industries where there is a shortage of available job seekers and is one of the very few categories under which a migrant can apply for a travel exemption to get into Australia. All empl...oyers are required to publish 2 job advertisements on a prominent or professional recruitment website with national reach or national print media (newspapers, magazines), on national radio or on the business’s website if the sponsor is an accredited sponsor for at least 28 days. These positions must also be advertised on the Australian government employment website, JobActive, for 28 days. The advertisement must contain the title or a description of the position as well as the skills or experience required for the position and the name of the approved sponsor or the name of the recruitment agency being used by the sponsor. The advertisement must also contain the salary for the position if the annual earnings for the position are lower than $96,400. So what are the costs to a business when hiring an overseas worker on a 482 visa? Firstly, the annual salary of an advertised position must be above the Temporary Skilled Migration Income Threshold (TSMIT), which at the moment stands at AUD53,900 plus superannuation. The business must also pay the Skilling Australians Fund (SAF) levy for each 482 Visa they sponsor, this levy is dependent on the size of the business, with businesses with an annual turnover of less than $10 million paying $1,200 per year. Businesses with an annual turnover of more than $10 million must pay $1,800 per year per sponsored employee. For a business in Australia to sponsor an employee on a 482 visa, they must hold either a Standard or Overseas Business Sponsorship which costs $420 and is valid for 5 years or be a party to a labour agreement.
