14.01.2022 Did you know? The Adjudication process can be completed without the need of face to face contact? Unlike the court process, all you are required to do is provide all of your required paperwork over email to ASC, and we take it from there. ... No need to present in court, no need to face your respondent, it can all be completed over written submissions. This makes the process much less time consuming for yourself (the Claimant).

14.01.2022 The Security of Payments Act applies when the two parties involved are businesses. This means that both parties must have an ABN or ACN. We do not have jurisdiction when a Tradesperson carries out works for a residential / private party. However, we do have jurisdiction when you carry out works at a private residence, but the party you are carrying out the works for, is a business.

We will endeavour to explain the procedures required, the terminology, which can sometimes feel overwhelming, and put it all into layman’s terms. Firstly, here are the explanations of all parties involved in the Adjudication process:... CLAIMANT - The business or individual that is owed the outstanding monies, after supplying the goods or services that was agreed upon. (The one that hasn’t been paid!) RESPONDENT - The business or individual who owes the monies to the Claimant. (The one that hasn’t paid!) ADJUDICATOR - the person appointed to determine the matter at hand. (The one who makes the decision as to the correct amount owed by the Respondent, if any) AUTHORISED NOMINATING AUTHORITY (ANA) - Thats us! We are authorised by the State Government to appoint an Adjudicator to the matter at hand. We also help individuals and businesses better understand their rights and the requirements of the Security of Payments Act. Our job is to send all correspondence between the parties (the Claimant and the Respondent) and the Adjudicator. Parties will correspond with the Adjudicator through us.
