13.01.2022 FROM STATE GROWTH TAS: -------- Bridging Visa holders: Section 48 bar - ----------unable to lodge due to travel restrictions If supported for visa state nomination a Subclass 491 applicant who holds a Bridging Visa A, B, C or E while seeking review of a decision would be required to depart Australia in order to lodge their visa application with the Department of Home Affairs. While travel restrictions are in place many applicants will find it difficult to depart Australia and... all will be unable to enter Australia (unless exempt). In an effort to manage this situation all applications on hand and lodged thereafter by candidates who hold a Bridging Visa A, B, C or E will be assessed as normal with one of the following three results: Applicants who are not successful as a result of the competitive assessment will be advised of their outcome and should not reapply until travel restrictions are lifted. Applicants who are successful as a result of the competitive assessment and do not have a Section 48 Bar will be advised of their outcome. Applicants who hold a Bridging Visa associated with Administrative Appeal Tribunal (AAT) or Federal Court review will be placed ON HOLD until the travel ban is lifted at which time these applications will be further assessed in consideration of an updated residential location and employment details (if applicable) then finalised.



12.01.2022 Some clients are very worried. At times requirements for visas can cause overwhelm and even fear. I have a client in quarantine in a hotel right now. Here's what I say: keep it as simple as possible to start. Let's focus on 'time of application requirements' now to ensure a valid application is lodged. After that we will focus on 'time of decision requirements'. (This is not possible for some visas with all requirements being needed at the time of application) For me, I have... to focus on what is realistically achievable today. COVID-19 is making it tough. Although the Department of Home Affairs have cracked down, they are being flexible with deadlines for those who have lodged an application ( not in all cases). The same applies for the Administrative Appeals Tribunal. Always lodge a request for further time via email or IMMIACCOUNT to ensure you are granted further time.
