22.01.2022 #caringaboutcognition #professionallife | The primary duty of a professional is NOT just to blindly assume their client has decision making capacity BUT to consider actively, is their client competent to instruct and work with them. Great mischief occurs when social and rational conduct is allowed to masquerade as decision making ability. WHEN a person appears to have diminished ability or cognitive capacity: (a) WHO is the client/patient? (b) HOW do you take instructions? (c...) HOW might you help the person, family or group in need to make decisions? (d) WHAT competencies help minimise professional negligence exposure when onboarding such a client? Bring your questions for these issues to the STEP South Australia Young Professionals webinar via Zoom, presented by Autonomy First Lawyers Pty Limited professionals, neuropsychologist Dr Jane Lonie and wills, estates and trusts lawyer Michael Perkins. In 2020 they founded the Capacity & Capability Clinic where methodologies developed over decades are applied to help clients deal with their health, wealth, residence, wellbeing and related needs as they age. Date: 5 Aug 2020, 5:30-6:30pm via Zoom CPD: 1 unit. Cost: $40 Register: Kylie Hender, Secretariat STEP SA. 0417 805 314 [email protected]

19.01.2022 On the value of file notes in professional services.

19.01.2022 0:05 "Lawyers in an ageing world" - Dr Lise Barry (MQ Uni) 22:21 "Designing professional businesses" - Noric Dilanchian 46:12 "Active ageing in the digital economy" - Panel Discussion with Anthony Wong, Michael Perkins and Noric Dilanchian... For the full symposium speakers and topics list see the YouTube description field. Held in Sydney on 23 October 2019 the symposium addressed rapid changes in the socio-economic, legal and ethical frameworks of Australian society. These changes have a significant impact on ageing and cognitively impaired clients. As this group’s needs and issues have grown and become more complex, so too have the responsibilities of professionals when dealing with such clients. The symposium was generously supported by the Sydney Community Foundation & Sydney Women's Fund, Nexus Law Group, and community radio station 2ser. It was a joint initiative with The College of Law Australia within the framework of the broader topic of professional responsibility. Participants were practitioners from a wide variety of disciplines including neuropsychology, nursing, financial planning, and government policy development. #CaringAboutCognition #AutonomyFirst #ageingwell #agedcareaustralia #ageing #CapacityandCognition https://youtu.be/62tjeRogaLU

17.01.2022 Our firm puts autonomy first. A reason is there’s a great deal wrong with attitudes about ageing in Australia. #Ageism is rampant. Its normalisation as a type of discrimination must be rooted out. The World Health Organisation recognises ageism as insidious and defines it as stereotyping, prejudice, and discrimination against people on the basis of their age. Ageism results in people being under-utilised, overlooked and marginalised, inviting elder abuse. It’s dumb, it’s da...ngerous and erodes societal values. https://thenewdaily.com.au//madonna-king-older-austra/amp/

09.01.2022 By 2050 one in five of our population will be over 65 years of age. Alzheimer’s Australia tell us that one in ten of every person aged 65 years or older suffers with dementia. The figure rises to three in ten by the age of 80 years. As legal and medical practitioners dealing with elderly clients on a regular basis, the stats alone tell us that you will inevitably encounter cognitive impairment and the accompanying issues of undue influence and capacity. In this article Clinical Neuropsychologist Dr Jane Lonie looks at the link between cognitive impairment and undue influence and the implications for supported decision making. https://autonomyfirstlawyers.com//supported-decision-maki/ #dementiasupport #undueinfluence #cognitivedecline

02.01.2022 A problem of our era is helping people to cope with the prospect of a 100 year life. Part of that involves avoiding the immense cost and consequences of family wealth disputes. These are points made by international expert on family wealth, Dennis Jaffe. He wrote the preface for the 3rd and 4th editions of the Estate Planning book co-authored by Michael Perkins of our firm. Exacerbating the situation in 2020-2021 is a recession with declining economic prosperity, declining fa...mily capital, and the increasing costs of access to the justice system. Activity that can counter-balance such circumstance is self-help by individuals, families, and communities of which they are part. Estate planning is part of that. Autonomy First Lawyers Pty Limited leads in a range of services related to that area of need. Adult lives involve wealth creation, protection, administration, allocation, and distribution. To protect what we have created each of us needs to engage professionals with specialist knowledge. They include accountants, lawyers, financial advisers, and insurers. Where wealth is held in more than one country or legal jurisdiction, cross-border knowledge is also needed.
