21.01.2022 485 visas - The law has changed. Those who have held a 485 visa before cannot apply for a second 485 visa unless you have studied and worked in a regional area in relation to extending your 485 visa. This means if you have held a 485 visa previously as a dependent on your partners 485 visa, you will not be eligible to apply for your own 485 visa as a primary applicant.

18.01.2022 COVID-19 VISA Temporary Work visa holders including working holiday makers employed in critical sectors who have not completed the 3 or 6 months of specified work required to apply for a second or third Working Holiday Maker visa, and are unable to leave Australia, may be eligible for a Temporary Activity (subclass 408 Australian Government Endorsed Event (AGEE) stream) visa. This visa will allow working holiday makers to remain lawfully in Australia, and continue working, if... they wish to do so, until they can return to their home country. Those already in Australia with the Seasonal Worker Program whose visas are expiring, will be able to extend their stay in Australia by applying for a Temporary Activity (subclass 408 Australian Government Endorsed Event (AGEE) stream) visa. Holders of other temporary work visas / TSS 482 visa /457 visa currently employed in critical sectors may also be eligible for a Temporary Activity (subclass 408 Australian Government Endorsed Event (AGEE) stream) visa. Australian Government endorsed events This temporary visa lets you come to Australia to participate in events which are endorsed by the Australian Government. 14.01.2022 Important change to Work Experience points DHA have changed the way that they will assess work experience points for some occupations. In the past, if a person was assessed by some skills assessment authorities (Vetassess, ACS (offshore), AIM, etc) the assessing body would determine a deeming date. Any work experience that was undertaken prior to this deeming date was unable to be counted as skilled for work points. DHA has now CHANGED this policy and instead will allow a...ny work experience that takes place after obtaining the qualifications/work experience (as determined by ANZSCO) to count for points. This is their new policy: When assessing periods of skilled employment for the purpose of awarding points, the following must be taken into account: the opinion of the relevant skills assessing authority on the period of skilled employment including the date on which they deemed the applicant skilled; and the Australian and New Zealand Standard Classification of Occupations (ANZSCO) including any pre-requisite qualifications/work experience relevant to the claimed skilled employment; and any other relevant information (such as employment records and references). If the skills assessing authority’s opinion would result in the applicant being awarded fewer points than the applicant claimed in their EOI, then decision-makers should consider the information in ANZSCO and apply the more beneficial outcome in determining when the applicant was working at a skilled level. For example, if a person has an acceptable degree in Marketing, and works the required 12 months for a Vetassess skills assessment as a Marketing Specialist, DHA would not count this 12 months as skilled work in the past. Now they will as ANZSCO says only a degree is needed to meet the Australian standards for that occupation. Similarly, if an overseas IT graduate works 5 years as an ICT Security Specialist. The ACS would use the first 2 years to meet their own skills assessment standards, leaving just 3 years counting as skilled for DHA points. Now the whole 5 years will count as skilled for points as ANZSCO requires just a relevant degree for that occupation This will likely assist many people in claiming work experience to meet any state sponsorship requirements. As in the past, many states copied DHA policy and did not count work obtained prior to a deeming date.

Eligible for a second or third WHV afterwards. 482/457s: if stood down but not laid-off, i.e. unpaid leave effectively, will maintain visa validity without breach and able to lodge new 457/482 where business is still sponsoring. Businesses able to reduce work hours without ...breach. Able to access $10K super this financial year. Those with 4-year 457/482s re-employed can count time spent in Australia towards PR. NZ444: in Australia before 26 Feb 2001 will have access to welfare and JobKeeper payments. Those arrived after 2001 have access to JobKeeper but not welfare. Everyone else should consider departing if unable to support themselves. International Students: if here longer for 12 months, can access superannuation to support themselves if unable to rely on family support from overseas. Some institutions providing fee discounts. If working in aged care and as nurses then can work longer than 40 hours a fortnight already. MOST IMPORTANTLY: those already working in supermarkets on extended work rights will have these work rights cease on 1 May 2020 to normal 40 hours a fortnight because more Australians are going to be recruited to fulfill these roles. 07.01.2022 Canberra Skills Integrity check ACT Residence SC 190 and SC 491 The Migration Institute of Australia has become aware that Skills Canberra is conducting an integrity check of continued ACT residence for those who have been nominated for a subclass 190 visa by the ACT government. If Skills Canberra is not satisfied that the ACT nominees are currently resident in Canberra, their ACT 190 nomination may be withdrawn. If ACT 190 nomination is withdrawn, the Department is unable to... grant the visa. Integrity check of continued ACT residence for ACT SC 491 nominees to commence shortly. 04.01.2022 Notice about the 491 - SBO (Small Business Owners) Program From April 1st 2021 - the pre-existing business purchased will need to have been in operation for 2 years instead of 1 year. There will also need to be a minimum purchase price of $100,000 (rather than total investment in the business).... Furthermore, sub-leases of franchises (such as petrol stations), and home-based businesses (such as courier and cleaning businesses) will not be considered. These requirements are aimed at ensuring the program is sustainable in the long-term.
