20.01.2022 An enduring power of attorney is a legal document that allows you (the principal) to nominate one or more persons (referred to as attorneys) to act on your behalf. An enduring power of attorney gives the attorney the authority to manage your legal and financial affairs, including buying and selling real estate, shares and other assets, operating your bank accounts and spending money on your behalf.

20.01.2022 New Tenancy Reforms strengthen the rights of domestic violence victims. * Victims of domestic violence can now end their tenancies immediately, without liability, by attaching specified documents to a domestic violence termination notice. * Victims of domestic violence are no longer vicariously liable for damage to rental properties caused by domestic violence offenders. * Landlords are now prohibited from listing a person who ended their tenancy by giving a domestic violence termination notice on a bad tenant database.



20.01.2022 On 1 January 2011, the Competition and Consumer Act 2010 (Cth) sch. 2 (Australian Consumer Law) (the 'ACL') commenced operation as Australia's first nation-wide consumer protection law. A report published in April 2017 identified a package of reforms to strengthen and clarify the law, and on 18 October 2018 law was introduced to implement the first package of reforms. Unsolicited Consumer Agreements You have rights under the Australian Consumer Law when a salesperson approach...es you at your front door (door-to-door selling), over the phone (telemarketing), or in a public place (shopping centre etc). These protections apply to sales methods that are called ‘unsolicited consumer agreements’. Price Transparency in Pre-selected Options As the technology for online sales has advanced, many consumers have ended up paying more than they expected because of commonly used online payment systems that include pre-selected options. This is most often seen in online airline ticket sales where seat selection and baggage might be pre-selected and require the consumer to 'untick boxes' to remove the additional fees and charges. The new law forces sellers to present options in a transparent way.

19.01.2022 The standard common law test of criminal liability is expressed in the Latin phrase 'actus reus non facit reum nisi mens sit rea', i.e. "the act is not culpable unless the mind is guilty". In jurisdictions with due process, there must be both actus reus ("guilty act") and mens rea ("guilty mind") for a defendant to be guilty of a crime. As a general rule, someone who acted without mental fault is not liable in criminal law. Exceptions are known as strict liability crimes.

P...arties choose their arbitrator from a list of registered arbitrators maintained by the Australian Institute of Family Law Arbitrators and Mediators (AIFLAM) or agree to an arbitrator nominated by AIFLAM. The Arbitrator's Award must include a concise statement setting out the Arbitrator's reasons for making the award, their findings of fact and the evidence on which tbe findings are based (FL Reg 67P). Either party may apply to register the Arbitral Award. (FL Reg 67Q).

03.01.2022 An Executor Must Act Personally The office of executor is a gratuitous one and the appointee must act personally. (See In the Will of Shannon [1977] 1 NSWLR 210 at 214G.) As a general rule, an executor is expected to carry out his or her duties, including keeping accounts, personally. If he or she chooses to employ another person to carry out executorial tasks, the charges will be to his or her own account. However, where, having regard to the size and nature of the estate an...d the tasks that need to be carried out, it is reasonable for the executor to engage the services of another, the expense may be allowed as a disbursement. (See Chick & Anor v. Grosfeld (No 3) [2012] NSWSC 1536 at 7.) The general rule is that an executor may delegate work to a person duly qualified to perform work on behalf of the estate, at a rate commensurate with the work performed.
